said County that there is immediate need therefor for right of way
for County roads or streets, the County Council may provide that
such property may be taken immediately upon payment therefor to
the owner or owners thereof, or into court, such amount as an ap-
praiser appointed by a Court of Record shall estimate to be the fair
market value of such property, provided that the Council shall secure
the payment of any further sum that may subsequently be awarded
by a jury. This section shall not apply in Montgomery County if the
property actually to be taken includes buildings or improvements.

Sec. 2. And be it further enacted, That the foregoing amendment
to the Constitution of the State of Maryland shall, at the election to be
held in November, 1962, be submitted to the legal and qualified
voters of the State for their adoption or rejection, in pursuance of
the directions contained in Article 14 of the Constitution of the State
of Maryland, and at the same general election the vote on the said
proposed amendment to the Constitution shall be by ballot, and upon
each ballot there shall be printed the words: "For Constitutional
Amendment" and "Against Constitutional Amendment", as now pro-
vided by law, and immediately after said election due returns shall be
made to the Governor of the vote for and against the proposed
amendment, as directed by said Fourteenth Article of the Constitu-
tion, and further proceedings had in accordance with said Article 14.

CHAPTER 330
(Senate Bill 335)

AN ACT to add new Section 122A to Article 27 of the Annotated
Code of Maryland (1957 Edition), title "Crimes and Punish-
ments", to follow immediately after Section 122 thereof and to be
under the new sub-title "CONTRABAND, "Drugs and Liquors in
Prisons", making it a misdemeanor to illicitly convey to or from
penal institutions ANY MEANS OF ESCAPE, intoxicating
liquors, BEVERAGES, stimulating sedatives e*? , narcotic OR
DANGEROUS drugs, and providing penalties therefor.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 122A be and it is hereby added to Article 27 of the
Annotated Code of Maryland (1957 Edition), title "Crimes and
Punishments", to follow immediately after Section 122 thereof and
to be under the new sub-title "CONTRABAND, "Drugs and Liquors
in Prisons", to read as follows:

CONTRABAND, Drugs and Liquors in Prisons

122A. Whoever delivers or procures to be delivered, or has in his
possession with intent to deliver, to a convict
PERSON LEGALLY
DETAINED AND confined in any penal institution or, REFORMA-
TORY OR OTHER place of confinement within the State, or who-
ever deposits or conceals in or about the institution, or upon any land
appurtenant thereto,
ANYTHING TO EFFECT THE ESCAPE OF
A PRISONER OR INMATE LAWFULLY DETAINED THEREIN,
any intoxicating liquor, BEVERAGE, stimulating sedative or,, nar-
