county commissioners of such county shall thereafter have no juris-
diction to hear or determine tax appeals, or to assess, classify, re-
assess or reclassify property for purposes of taxation; but all such
powers and duties shall be vested in the appeal tax court, subject to
a right of appeal to the Maryland Tax Court, as provided in the case
of assessments by the county commissioners. Nothing in this sub-
title shall affect the powers and duties of the board of municipal and
zoning appeals in Baltimore City, as prescribed by local law and
ordinance. [The provisions of this sub-title shall apply only in Balti-
more and Montgomery counties.]
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.

AN ACT to repeal and re-enact, with amendments, Section 108 (14)
of Article 52 of the Annotated Code of Maryland (1960 Supple-
ment), title "Justices of the Peace", sub-title "Trial Magistrates
System", relating to the salary of the trial magistrate of Kent
County.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 108 (14) of Article 52 of the Annotated Code of Mary-
land (1960 Supplement), title "Justices of the Peace", sub-title 'Trial
Magistrates System", be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

(14) There shall be one trial magistrate who shall sit at Chester-
town and who shall receive an annual salary of not less than $1,800.00
nor more than $3,000.00 as the County Commissioners of Kent
County may from time to time determine. There shall also be one
associate trial magistrate who shall receive an annual salary of
$1,000.00. During the temporary absence or inability of the trial
magistrate, the associate shall serve in his place with the same au-
thority and power as the trial magistrate. In such case he shall
receive from the County Commissioners the same prorata amount as
compensation that the magistrate would have received, and the same
expenses the magistrate would have received. The salary of the
magistrate shall in such cases be diminished by a sum necessary to
compensate the associate magistrate for any period of absence or
inability in excess of thirty days in any one year. The Sheriff of
Kent County and his deputies are hereby authorized, directed and re-
quired to serve all civil and criminal process issued by said magistrate.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.
