CHAPTER 191
(House Bill 68)

AN ACT to repeal and re-enact, with amendments, Sections 190, and
198, 199 AND 200 of Article 77 of the Annotated Code of Mary-
land (1957 Edition), title "Public Education", sub-title "Chapter
16. Public Libraries", relating generally to the inclusion of certain
employees of the Enoch Pratt Free Library of Baltimore City, OF
THE DEPARTMENT OF PUBLIC LIBRARIES OF MONT-
GOMERY COUNTY AND OF THE WASHINGTON COUNTY
FREE LIBRARY, in the definition of the term "Teacher" for and
in connection with certain contributions of money made by the
State of Maryland to certain political subdivisions of said State
which provide, maintain or operate retirement or pension systems
for or covering their teachers, PROVIDING FOR THE DETAILS
OF AND THE PROCEDURE FOR THIS INCLUSION, and pro-
viding that this Act shall take effect June 1, 1961.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 190, and 198, 199 AND 200 of Article 77 of the An-
notated Code of Maryland (1957 Edition), title "Public Education",
sub-title "Chapter 16. Public Libraries", be and the same are hereby
repealed and re-enacted, with amendments, to read as follows:

190. Inclusion of professional and clerical employees in Teachers'
Retirement System.

(a)  The professional and clerical employees of any library estab-
lished or operating under the provisions of this subtitle shall be
included in the definition of "teacher" and "member", as said terms
are defined respectively in subsections (3) and (4) of Section 108 of
this article, and all such professional and clerical employees shall be
entitled to all the rights and privileges and subject to all of the
obligations of the Teachers' Retirement System as established and
maintained under Sections 108 to 129, inclusive of this article.

(b)  Beginning July 1, 1961, and continuing thereafter, the pro-
fessional and clerical employees of the Enoch Pratt Free Library of
Baltimore City shall be included in the definition of "teacher" as said
term is defined in subsection (3) of Section 108 of this article for and
in connection with any and all of the terms and provisions of Section
116 (6) of this article.

(C) NOTWITHSTANDING ANY OTHER PROVISION OF THIS
ARTICLE OR OTHER STATUTE, THE STATE OF MARYLAND
SHALL MAKE CONTRIBUTIONS TO THE RETIREMENT AND
PENSION SYSTEM, AND CONTRIBUTIONS FOR THE EM-
PLOYER'S SHARE FOR SOCIAL SECURITY, FOR THE BENE-
FIT OF THE PROFESSIONAL AND CLERICAL EMPLOYEES
OF THE DEPARTMENT OF PUBLIC LIBRARIES OF MONT-
GOMERY COUNTY AND THE WASHINGTON COUNTY FREE
LIBRARY IN THE SAME MANNER AND TO THE SAME EX-
