(d) The County Council is further empowered and authorized to
fix a penalty not in excess of a fine of $1,000.00 or imprisonment not
exceeding six months, or both such fine and imprisonment, for viola-
tion of the provisions of any resolution or ordinance of said County
Council adopted pursuant to this section.

Sec. 2. And be it further enacted, That this Act shall take effect
on June 1, 1961.

CHAPTER 181
(House Bill 335)

AN ACT to repeal and re-enact, with amendments, Section 37 (a)
(3) of Article 73B of the Annotated Code of Maryland (1960
Supplement), title "Pensions", sub-title "Social Security Benefits",
to provide that modifications of the agreement between the State
of Maryland and the Secretary of Health, Education and Welfare
relating to coverage under the Federal Old Age and Survivors
Insurance System shall be effective as to services performed be-
tween certain dates, and relating generally to the services as to
which modifications of such agreement shall be effective.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 37 (a) (3) of Article 73B of the Annotated Code of
Maryland (1960 Supplement), title "Pensions", sub-title "Social
Security Benefits", be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

37.
(a)

(8) Such agreement shall be effective with respect to services in
employment covered by the agreement performed after a date speci-
fied therein, but in no case on a date prior to January 1, 1951, or in
no event [may it be effective with respect to any services performed
prior to the first day of the calendar year in which such agreement
is entered into or in which the modification of the agreement making
it applicable to such services, is entered into except that a modifica-
tion entered into after December 31, 1954, and prior to January 1,
1958, may be effective with respect to services performed after
December 31, 1954, or after a later date specified in such modifica-
tion; and except that a modification entered into after December 31,
1957, but prior to January 1, 1960, may be effective with respect to
the services performed after December 31, 1955, or after a later
date specified in such modification;] can coverage be made retro-
