(h) (I) [(g)] Imitation ice cream is any frozen substance, mixture
or compound regardless of the name under which it is represented,
which is made in imitation or semblance of ice cream, or is prepared
or frozen as ice cream is customarily prepared or frozen, and which
is not ice cream, frozen custard, sherbet, water ice or fruit ice
or ice milk as they are defined in this section.
(i) (J) [(h)] Frozen ice confections are "water ice" or "fruit ice"
as herein defined, manufactured into factory-formed individual serv-
ings, which must be purveyed to the consumer in properly identified
individual packages, bags or suitable sanitary wrappers, except they
may be frozen without agitation, may contain harmless flavoring
and the acid requirements provided for in the definition of "water
ice" or "fruit ice" need not be met.
(j) (K) [(i)] Frozen sherbet confections are "sherbet" as herein
defined, manufactured into factory-formed individual servings, which
must be purveyed to the consumer in properly identified individual
packages, bags or suitable sanitary wrappers, except they may be
frozen without agitation, may contain harmless flavoring and the acid
requirements provided for in the definition of "sherbet" need not be
met, and it may contain not more than fourteen per centum by weight
of total milk solids, of which not more than two and one-half per
centum may be milk fat.
(k) (L) [(j)] Frozen ice confections or frozen sherbet confections
shall be manufactured for sale, stored, sold or dispensed only in in-
dividual portions, packages or containers prepared in such form at
the place of manufacture and cannot be used in the manufacture of
milk shakes. Every such individual portion, package or container
shall be labeled in letters not less than 1/8 inch in size with the words
"Frozen Ice Confection" or "Frozen Sherbet Confection," respec-
tively.
(l) Ice milk means the pure, clean frozen products made from a
combination of "milk products"-, sugar,- dextrose, corn syrup in dry
or liquid form, water, with or without egg or egg products, with
harmless flavoring and with or without harmless coloring, and with
or without added "stabilizer" and emulsifier" composed of wholesome
edible material. It shall contain not more than one-half of one per
centum by weight of emulsifier, not less than four percentum, nor
more than seven per centum by weight of milk fat, and not less than
eleven per centum by weight of total milk solids. In no case shall any
ice milk weight less than four and one-half pounds per gallon and con-
tain less than one and three-tenths (1.3) pounds of total food solids
per gallon. Ice milk, as herein defined, shall be manufactured for
sale, stored or dispensed in individual pint, quart or half-gallon pack-
ages or containers prepared in such forms at the place of manu-
facture and cannot be dispensed in bulk form either in individual
portions or in the preparation of milk shakes or other milk drinks,
it being the legislative intent that the sale of ice milk shall be for
off-premises consumption only. No retailer who dispenses ice milk
for public consumption shall have an open or partially filled pint,
quart or half gallon package or container of ice milk on his premises.
Every such individual pint, quart, or half gallon package or con-
tainer of ice milk shall be plainly and distinctly labeled as "ice milk"
in letters as large as the largest letters on said package or container.'
