CHAPTER 841
(House Bill 737)

AN ACT to repeal Sections 1 and 4 of Article 43 of the Annotated
Code of Maryland (1957 Ed.), title "Health", subtitle "State Board
of Health"; and to repeal Section 16 of Article 59 of the Annotated
Code of Maryland (1957 Ed.), title "Lunatics and Insane", sub-
title "Department of Mental Hygiene", and to add new Sections
1A through 1H of Article 43 of the Annotated Code of Maryland
(1957 Ed.), revising the organization of the State Department of
Health and the Department of Mental Hygiene and creating a
State Board of Health and Mental Hygiene, and relating generally
to the State Board of Health and Mental Hygiene and its powers,
duties and functions; and also relating generally to the work,
powers, personnel, duties and functions of the newly-created State
Board of Health and Mental Hygiene.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 1 and 4 of Article 43 of the Annotated Code of Mary-
land (1957 Ed.), title "Health", subtitle "State Board of Health"
and Section 16 of Article 59 of the Annotated Code of Maryland
(1957 Ed.), title "Lunatics and Insane", subtitle "Department of
Mental Hygiene" be repealed, and new Sections 1A through 1G be
added to Article 43 of the Annotated Code of Maryland (1957 Ed.),
to read as follows:

1A (Creation)The State Board of Health and Mental Hygiene
is hereby created with the powers and duties in this Article specified.
The State Board of Health, the Mental Hygiene Advisory Board and
the Mental Hygiene Board of Review are hereby abolished.

1B (State Board of Health & Mental Hygiene)—The State Board
of Health and Mental Hygiene shall have care of the health interests
of the people of this State; shall establish, maintain and operate
PROVIDE in-patient and out-patient facilities for the treatment and
care of chronically ill, mentally ill, mentally retarded and tuberculous
persons; shall establish and operate
PROVIDE preventive services
and medical hospital and home care programs for the indigent and
medically indigent; and shall establish policy and supervise the func-
tions delegated to
FOR the State Department of Health and the State
Department of Mental Hygiene.

1C (Composition, Term, etc.)—The State Board of Health and
Mental Hygiene shall consist of eleven members as follows: Five
shall be experienced physicians, two of whom shall be qualified and
experienced psychiatrists specializing in the care and treatment of
the mentally ill.
ONE OF THE MEMBERS SHALL BE A
DENTIST. Each of the remaining members shall be persons
experienced and qualified in one of the following fields: dentistry,
hospital administration, public administration, nursing, pharmacy,
radiation control and sanitary engineering. The members of the
Board of Health and Mental Hygiene shall be appointed by the
Governor, with the advice and consent of the Senate, for terms of six
years. The Governor shall appoint said members biennially in groups
of four, four and three, respectively, with at least one physician
among each group of appointees. The Governor shall appoint four
members for a term expiring on the first Monday of May, 1963;
four members for a term expiring on the first Monday of May, 1965;
