WATER FISHERIES SHALL ISSUE A HYDRAULIC OR ME-
CHANICAL DREDGE LICENSE FOR THE TAKING OF SOFT
SHELL CLAMS FOR SUCH BOAT OR RIG IN THE COUNTY OF
WHICH THE APPLICANT IS A RESIDENT AND SHALL RE-
CEIVE THEREFOR $25.00. LICENSES ISSUED HEREUNDER
SHALL BE VALID FOR TWELVE (12) MONTHS FROM JULY
FIRST TO JUNE THIRTIETH.

(a)   How to apply for hydraulic dredge license.—Any person
wishing to take or catch soft shell clams (mya arenaria) with any
hydraulic or mechanical dredge or rig in the waters of Queen Anne's
County or the waters of the Chesapeake Bay adjacent thereto shall
appear before the Commission of Tidewater Fisheries [and] or shall,
by mail to said Commission,
make application for a hydraulic or
mechanical dredge or rig license. Every such applicant shall exhibit
to said Commission satisfactory evidence showing the name or num-
ber and size of the boat or rig; the size of the blade, water manifold
and conveyor or elevator on the boat or rig to be used, and make
further oath or affirmation that he is the bona fide owner of such
boat; that there is no lien on said boat held by nonresident of Mary-
land; that he has been a resident of Queen Anne's County for at least
one year prior to the making of such application, and that the in-
formation he has furnished concerning the rig is true.

(b)   Issuance of license and duration.—Upon the receipt of the
application and upon making such oath, the Commission of Tidewater
Fisheries shall issue a hydraulic or mechanical dredge license for the
taking of soft shell clams for such boat or rig and shall receive there-
for [$50.00] twenty-five dollars ($25.) as a license fee. Licenses
issued hereunder shall be valid for twelve (12) months from July 1st
to June thirtieth.

(d) Licenses to operate dredges; propeller guard; modifications
of dredges, boats and rigs.—The rules and regulations adopted by the
Commission of Tidewater Fisheries shall provide that any person,
desiring a license to operate a hydraulic, mechanical, or other dredge
for the catching or taking of soft shell clams, shall be the owner of
his boat and a resident of the county for one year prior to his applica-
tion, and each member of the crew of his boat or rig, must be, for a
period of one year prior to his application, a bona fide resident of
the county in which he wishes to operate such dredge, that any license,
issued by the Commission of Tidewater Fisheries, shall specify the
county in which such operation is authorized, shall be valid for twelve
(12) months from July first to June thirtieth, and the fee therefor
shall be [fifty dollars ($50.00).] twenty-five dollars ($25.). A pro-
peller guard shall be used as may be required by the Commission of
Tidewater Fisheries. The Commission of Tidewater Fisheries may
require such modifications to the hydraulic clam dredge and/or
licensed dredge boats and rigs as may be demonstrated to be in the
public interest through research of the Department of Research and
Education and recommended for adoption to the latter agency.
