MODIFYING PROVISO PERTAINING TO THE GENERAL
PLAN OF ARTERIAL OR OTHER THROUGH ROADS.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 66 (b) of Chapter 780 of the Acts of 1959, be and the
same is hereby repealed and re-enacted, with amendments, said law
having enacted the sub-title "Park and Planning Commission", to be
added to the Montgomery County Code—1955, being Article 16 of
the Code of Public Local Laws of Maryland, and to be added to the
Code of Public Local Laws of Prince George's County (1953 Edi-
tion), being Article 17 of the Code of Public Local Laws of Mary-
land, and said Section 66 (b) being in the sub-heading "Regional
District", to read as follows:

66. Local planning boards for each county.

(b) Regional functions; procedure for Commission.

(1) The regional functions within the jurisdiction of the Com-
mission shall include, but shall not be limited to, preparation, adop-
tion, and amendment of the general plan for the physical develop-
ment of the District, or parts thereof, in accordance with Section
63 of this sub-title; [provided, however, that insofar as shall pertain
to the location, arrangement, character and extent of roads under
the said section such regional functions shall include planning only
for such roads as are either arterial or other through roads extend-
ing from one of the said counties in the Regional District into the
other;] and mandatory referrals from the United States or the
State of Maryland, or any agency thereof, pursuant to Section 67 of
this sub-title. The Commission and the county planning boards, or
either of them, are authorized to recommend to the proper authorities
text amendments to the zoning ordinances, sub-division regulations,
and any other rules and regulations authorized in this sub-title. The
adoption of a resolution or recommendation respecting a regional
matter shall be carried by the affirmative votes of not less than six
members of the Commission, of whom not less than three members
shall be from Montgomery County and not less than three members
from Prince George's County; PROVIDED, HOWEVER, WHEN
A REGIONAL PLAN AFFECTS ONE COUNTY ONLY, THE
AFFIRMATIVE VOTE OF THREE MEMBERS OF THE LOCAL
PLANNING BOARD FOR THE COUNTY AFFECTED SHALL
BE CONTROLLING. Within its jurisdiction, each county plan-
ning board shall have and exercise the powers in regard to plan-
ning, zoning, sub-division control, platting, the assignment of street
names and house numbers, and related matters, heretofore exercised
by the Commission under this sub-title.

(2) All parts of the general plan of the Maryland-Washington

Regional District heretofore adopted by the Maryland-National
Capital Park and Planning Commission
pursuant to its statutory
enabling authority including Section 63 of this sub-title are hereby

ratified, approved and confirmed, and shall be deemed to have been

adopted in accordance with all the provisions of this sub-title, as
amended.

Sec. 2. And be it further enacted, That except as otherwise pro-
vided herein, all Acts or parts of Acts or laws and parts of laws
inconsistent herewith or contrary hereto are hereby repealed to the
extent of such inconsistency.
