tions were enacted by Chapter 694 of the Laws of Maryland of 1957,
be, and they are hereby, repealed and that two new Sections be and
they are hereby enacted in the place and stead of the Sections so re-
pealed, and to read as follows:
529. Creation of Sanitary District.
(a) There is hereby created a public body politic and corporate of
the State of Maryland, to be known as the Washington County Sani-
tary District, which shall be organized and shall have and may
exercise the powers and duties conferred by this sub-title whenever
the County shall, by ordinance or resolution filed and recorded as
herein provided, find that there is a need for said District, and de-
clare that the same shall function hereunder.
(b) In addition to such finding and declaration, such ordinance or
resolution shall set forth the boundaries of said District, which may
embrace all of Washington County or any part or parts thereof,
whether or not contiguous, but which shall not include areas within
any Federal reservation, or within any municipal corporation un-
less any such municipal corporation shall consent or agree to such
inclusion or shall annex a portion of the District subsequent to pas-
sage of such ordinance or resolution. Said ordinance or resolution
shall also set forth the names, addresses and terms of office of the
first members of the Commission of said District, hereinafter pro-
vided for. Said ordinance or resolution shall further recite that it
is adopted for the purpose of carrying out and implementing this
sub-title.
(c) Such ordinance or resolution, duly signed by the President
of the Board of County Commissioners of the County, with the County
seal affixed, attested by the County Clerk, shall, by said Clerk, be
filed and recorded with the Clerk of the Circuit Court for Washing-
ton County and, upon such filing and recording, said District shall
be conclusively deemed to have been lawfully and properly created
and established, and authorized to exercise its powers under this sub-
title.
(d) As soon as the Commission of said District shall have been or-
ganized and its officers elected, the Secretary-Treasurer thereof shall
file with the Clerk to the Circuit Court for Washington County the
names and addresses of such officers, as well as the principal office
or place of business of said District. Any change in either of the
aforegoing shall likewise be filed with said Clerk.
(e) The Clerk to the Circuit Court for Washington County shall
establish, among the records maintained by him, a book or other
suitable file, properly indexed, in which shall be entered or recorded
all ordinances, resolutions, plats and certificates filed with him pur-
suant to this sub-title.
(f) In the event the District shall have been incorporated pur-
suant to the provisions of Section 875 of Chapter 694 of the Laws
of Maryland of 1957 (being Section 529 of the Code of Public
Local Laws of Washington County, as the same appeared in the
1957 Edition of said Code), then, upon the filing of the ordinance
or resolution mentioned in said Section in the manner hereinabove
prescribed, said District shall, for all purposes, be deemed to have
