lating to the work of this Division and also the Division of Ad-
ministration and Finance, placing within the provisions of Article
64A of the Code certain personnel of these two Divisions, and
relating generally to the employees' powers and duties of said Di-
visions within the Department of Mental Hygiene.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 16 (c) and 16 (d) of Article 59 of the Annotated Code
of Maryland (1957 Edition), title "Lunatics and Insane", sub-title
"Department of Mental Hygiene", be and they are hereby repealed
and re-enacted, with amendments, to read as follows:
16.
(c) Division of psychiatric education and training.—There shall
be within the Department of Mental Hygiene the [Division of Psy-
chiatric Education and Training] Division of Medical Services, the
function of which shall be to advise, consult with and direct the staffs
of the several State institutions concerning psychiatric services, psy-
chiatric education and training, nursing, rehabilitation, and social
work [and food supervision]. The chief DIRECTOR of the division
of [psychiatric training and education] medical services, who shall
be known as the assistant commissioner, as well as [the technical and
professional] all personnel thereof, shall be appointed by the Com-
missioner of Mental Hygiene, [upon the recommendation of the ad-
visory board and shall receive such compensation as may be provided
in the Budget; they shall not be subject to the provisions of the merit
system law, and may be removed by the Commissioner of Mental
Hygiene for incompetency or misconduct] and these positions are
included in and subject to all the rights and privileges provided for
in the merit system provisions in Article 64A of this Code.
The [chief of the division of] director of psychiatric education and
training THE DIVISION OF MEDICAL SERVICES and the assist-
ant to the president of the University of Maryland for medical
affairs shall, from time to time, consult with each other with the
view of coordination and integrating the work of the several State
mental institutions with the work of the University of Maryland
Psychopathic Hospital to the end that the medical, nursing and other
personnel of their respective institutions may be utilized to the maxi-
mum benefit of the State of Maryland.
(d) Division of administration and finance.—There shall be within
the Department of Mental Hygiene the division of administration and
finance, the function of which shall be to advise, consult with and
direct the staffs of the several State institutions concerning person-
nel, [and] public relations, budget and accounting, procurement,
food services, farm management and engineering and maintenance.
The chief of the division of administration and finance, as well as
[the technical and professional] all other personnel thereof, shall be
appointed by the Commissioner of Mental Hygiene [with the ap-
proval of the advisory board and shall receive such compensation
as may be provided in the budget; they shall not be subject to the
provisions of the merit system law, and may be removed by the Com-
missioner of Mental Hygiene for incompetency or misconduct] and
these positions are included in and subject to all the rights and privi-
leges provided for in the merit system provisions in Article 64A of
this Code.
