cent by weight of stabilizer or emulsifier composed of wholesome
edible material. The finished product shall contain not less than
seventeen (17%) per cent by weight of total food solids.
This confection must be manufactured in the form of servings,
individually packaged, bagged or otherwise wrapped, properly labeled
and purveyed to the consumer in its original factory-filled package.
In the production of these quiescently frozen confections, no pro-
cessing or mixing prior to the quiescent freezing shall be used that
develops in the finished confection mix any physical expansion in
excess of ten (10%) per cent.
(j) "Quiescently Frozen Dairy Confections'9 mean a clean and
wholesome frozen product made from water, milk products and sugar,
with added pure or imitation flavoring, with or without added harm-
less coloring,, with or without added stabilizer and with or without
added emulsifier; and in the manufacture of which freezing has not
been accompanied by stirring or agitation. It contains not less than
thirteen (13%) per cent by weight of total milk solids, not less than
thirty-three (33%) per cent by weight of total food solids, not more
than one half of (½) one per cent by weight of stabilizer, and not
more than one-fifth (1/5%) per cent of weight by emulsifier. Stabilizer
and emulsifier must be composed of wholesome, edible material.
This confection must be manufactured in the form of servings,
individually packaged, bagged or otherwise wrapped, properly
labeled, and purveyed to the consumer in its original factory filled

193.
(a) Imitation ice cream shall not be sold, possessed, advertised or
offered or exposed for sale by anyone at any time.
No person shall advertise, possess, or expose for sale, or offer for
sale, any frozen or partially frozen product or compound made wholly
or partly out of milk, cream (with or without added milk solids or
added milk fats), sweetening agent, flavoring, with or without color-
ing, or eggs, if it shall contain any fat, oils, or paraffin, other than
milk fat, except such fat or oils as are naturally contained in the
flavor used.
Frozen dairy foods and ices mean any or all of the following: Ice
cream, frozen custard, sherbet, water or fruit ice, [frozen ice con-
fections and frozen sherbet confections] and quiescently frozen con-
fections and quiescently frozen dairy confections? AND ICE MILK.
Frozen dairy foods and ices mix means the mix used in the freezing
of the above mentioned frozen foods and ices.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.
