one half of one per centum by weight of "stabilizer", and not more
than one fifth of one per centum by weight of "emulsifier", not less
than [twelve] ten per centum by weight of milk fat, not less than
twenty per centum by weight of total milk solids, not less than 1.4%
by weight of egg yolk solids, except when it shall contain fruits or
nuts, cocoa, chocolate, maple syrup, cakes or confection used for the
purpose of flavoring, then such reduction in milk fat, total milk
solids and egg yolk solids as is due to the addition of such fruits and
nuts shall be permitted, but in no case shall it contain less than eight
per centum by weight of milk fat nor less than [fifteen] sixteen per
centum by weight of total milk solids and [one per centum] one and
twelve one hundredths (1.12) per centum by weight of egg yolk solids.
In no case shall any frozen custard weigh less than four and one-half
pounds per gallon and contain less than one and six-tenths (1.6)
pounds of total food solids per gallon.
(C-l) ICE MILK MEANS THE PURE, CLEAN FROZEN PROD-
UCTS MADE FROM A COMBINATION OF "MILK PRODUCTS",
SUGAR, DEXTROSE, CORN SYRUP IN DRY OR LIQUID FORM,
WATER, WITH OR WITHOUT EGG OR EGG PRODUCTS, WITH
HARMLESS FLAVORING AND WITH OR WITHOUT HARMLESS
COLORING, AND WITH OR WITHOUT ADDED "STABILIZER"
AND EMULSIFIER COMPOSED OF WHOLESOME EDIBLE MA-
TERIAL. IT SHALL CONTAIN NOT MORE THAN ONE-HALF
OF ONE PER CENTUM BY WEIGHT OF "STABILIZER", NOT
MORE THAN ONE-FIFTH OF ONE PER CENTUM BY WEIGHT
OF EMULSIFIER, NOT LESS THAN FOUR PER CENTUM, NOR
MORE THAN SEVEN PER CENTUM BY WEIGHT OF MILK
FAT, AND NOT LESS THAN ELEVEN PER CENTUM BY
WEIGHT OF TOTAL MILK SOLIDS. IN NO CASE SHALL ANY
ICE MILK WEIGH LESS THAN FOUR AND ONE-HALF
POUNDS PER GALLON AND CONTAIN LESS THAN ONE AND
THREE-TENTHS (1.3) POUNDS OF TOTAL FOOD SOLIDS PER
GALLON. ICE MILK AS HEREIN DEFINED MAY BE MANU-
FACTURED FOR SALE, STORED, OR DISPENSED IN ANY
SIZE PACKAGES OR CONTAINERS NOT TO EXCEED HALF
GALLON PACKAGES OR CONTAINERS AND SAID PACK-
AGES OR CONTAINERS- SHALL BE PLAINLY AND DIS-
TINCTIVELY LABELED "ICE MILK" IN LETTERS AS LARGE
AS THE LARGEST LETTERS ON SAID PACKAGE OR
CONTAINER. ICE MILK MAY BE DRAWN FROM A FREEZER
AND EACH FREEZER MUST BE PLAINLY MARKED "ICE
MILK", IN A MANNER CONSPICUOUS TO THE PUBLIC, IN
LETTERS AT LEAST THREE INCHES (3") IN HEIGHT. ICE
MILK SHALL NOT BE DISPENSED OR SOLD FROM PACK-
AGES OR CONTAINERS FOR ANY USE WHATSOEVER. "DIS-
PENSED" SHALL MEAN DIPPING, SCOOPING, OR BREAKING
OF PACKAGES OR CONTAINERS.
[(c)] (d) "Sherbet" is a pure, clean, frozen product made from
"milk products", sugar, dextrose, corn syrup in dry or liquid form,
water, with or without egg or egg products and harmless fruit or
fruit juice flavoring and with or without harmless coloring with not
less than 0.35 of one per centum of fruit acid, as determined by titrat-
ing with standard alkali and expressed as lactic acid, and with or
without added "stabilizer" or "emulsifier" composed of wholesome
edible material. It shall contain not less than three per centum nor
more than five per centum by weight of total milk solids and
