stating that the petitioner is aggrieved by the action of the local board
and desires the court to review the same. The court shall thereupon
set the matter for hearing within thirty days after said petition is
filed. The case shall be heard by the court without a jury. The court
may admit into evidence the testimony, if any, in the hearings below;
however, it shall hear the case on its merits, de novo, and determine
to its own satisfaction the merits of the case and pass such order or
orders thereon as justice requires. The costs shall be awarded in the
discretion of the court.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.

CHAPTER 646

(Senate Bill 321)

AN ACT to add six new sections to Article 89B of the Annotated
Code of Maryland (1957 Edition), title "State Roads", sub-title
"Bridges", said new sections to be known as Sections 99A through
99F inclusive, and to follow immediately after Section 99 of said
Article, authorizing the State Roads Commission to participate
jointly with the State of Maryland and Worcester County in the
cost of constructing a bridge over Sinepuxent Bay between Assa-
teague Island and the mainland of Worcester County in an amount
not to exceed Five Hundred Thousand Dollars ($500,000.00); au-
thorizing the Commission to select the location, prepare the plans
and specifications and supervise the construction thereof; defining
certain elements of cost; providing for the charge and collection
of tolls for the use of said bridge and for the application of said
tolls; authorizing the Commission to enter into a contract with the
Board of Public Works and Worcester County setting forth the
terms, rights and obligations relating to the proposed structure
and authorizing Worcester County to take such action as may be
necessary to insure the construction of such structure.

Section 1. Be it enacted by the General Assembly of Maryland,
That six new sections be and they are hereby added to Article 89B of
the Annotated Code of Maryland (1957 Edition), title "State Roads",
sub-title "Bridges", said new sections to be known as Sections 99A
through 99F inclusive, and to follow immediately after Section 99
thereof, and to read as follows:

99A. The State Roads Commission of Maryland (herein called the
Commission) is hereby authorized and empowered to expend a sum
not exceeding Five Hundred Thousand Dollars ($500,000.00) out of
funds appropriated for the construction of roads and bridges, any
provisions of Section 32 (e) of Article 89B of the Annotated Code of
