C H A P. XL.
An ACT to open and eftablifh a road from Worton neck to Chefter-town, in
Kent county.

WHEREAS it is reprefented to this general affembly, by the petition of fundry inhabitants
of Worton neck, in Kent county, that they experience great inconvenience for want of a
direct road leading from faid neck to Chefter-town, as alfo a convenient communication with the
roads leading to the mills and places of worfhip in their neighbourhood;

Preamble.

II. BE IT ENACTED, by the General Affembly of Maryland, That Benjamin Chambers, James An-
derfon, junior, and Thomas Wilkins, foreft, be and they are hereby appointed commiffioners for
the purpofe, and any two of them are hereby authorifed and empowered to lay out and open, at
the expence of Kent county, a road, not exceeding twenty-five feet wide, beginning for the fame
at lot number one of the purchafe upon fales of the land of Richard Lloyd, deceafed, and run-
ning thence up the neck through the aforefaid land to the corner of John Rickets's lot, then
with his land until it interfaces the main road leading from John Bordley's farm in Worton neck
aforefaid to Chefter-town; and the faid road, when fo laid out and completed, fhall be recorded
among the records of faid county, and be thereafter deemed and taken to be a public road, and
fhall be kept in repair as other public roads in faid county are directed to be kept.

III. AND BE IT ENACTED, That the commiffioners aforefaid fhall and they are hereby directed
to apply to any juftice of the peace for the county aforefaid, who fhall iffue his warrant, under
hand and feal, directed to any conftable of the faid county, commanding him to fummon twelve
freeholders, difinterefted as to the lands, and not connected with any perfon through whofe lands
the faid road may pafs, to appear at a place and on a day by him to be appointed, and after
taking the following oath, or affirmation, as the cafe may be, to wit: " I, A. B. do fwear, or
" folemnly, fincerely and truly declare and affirm, that I will honeftly and faithfully eftimate and
" value the damage and injury fuftained by C. D. by opening a road through the land of the faid
" C. D. in purfuance of the directions of this act," fhall proceed to afcertain and value what
damages may be fuftained by any perfon or perfons through whofe land the faid road may pafs,
by opening and clearing the fame, and fhall return the damages by them affeffed to the clerk of
the faid county, and the damages fo affeffed fhall be conclufive; and after the valuation fo made,
the faid commiffioners fhall proceed to open and clear the fame, provided that the faid road fhall
not pafs through arty houfes, gardens, orchards or meadows, unlefs with the confent of the
owner thereof.

IV. AND BE IT ENACTED, That the clerk of the faid county, at their next levy court follow-
ing, fhall lay the damages fo affeffed before the faid court, and the juftices of the faid court fhall
levy upon the affeffable property of the faid county the damages fo adjudged to be fuftained by
the perfons through whofe lands the road as aforefaid fhall pafs, and which fum, when collected,
fhall be paid to the perfon or perfons fuftaining fuch damages by the collector of the faid county.

C H A P. XLI.
An ACT to authorife the building a market-houfe on the county wharf in
Chefter-town, in Kent county, and for the regulation of the faid market.

WHEREAS it has been reprefented to this general affembly, by the memorial of fundry in-
habitants of Chefter-town, in Kent county, that the market-houfe at prefent in faid town
is too fmall for the accommodation of the inhabitants thereof, and is fituated at fuch a diftance
from the water as to make it inconvenient to many perfons to attend the fame, and they have
prayed for the liberty of erecting another market-houfe on the county wharf in the faid town, at
their own expence, and to eftablifh the fame as a market, when it fhall be completely finifhed;
and the fame appearing reasonable to this general affembly, therefore,

II. BE IT ENACTED, by the General Affembly of Maryland, That Richard Tilghman, the fourth,
William M'Kenny and Robert Anderfon, be and they are hereby appointed commiffioners for
the purpofes in this act mentioned; and the faid commiffioners, or any two of them, are hereby
authorifed to receive, by fubfcription or otherwife, fuch fum or fums of money as they may
think neceffary for the purpofe of building a market-houfe on the public ground adjoining the
county wharf in Chefter-town, in Kent county, and the faid commiffioners, or any two of them,
be and they are hereby empowered, as foon as a fufficient fum of money fhall be fubfcribed, and
fuch part thereof collected as they may think neceffary, to contract and agree with any perfon
or perfons they may think proper to erect and build a market-houfe on fome part of the public
ground adjoining the county wharf in Chefter-town, in Kent county, to be fixed and agreed on
by the faid commiffioners, or any two of them, fufficiently large for the accommodation of the
inhabitants of the faid town.

III. AND BE IT ENACTED, That as foon as the faid market-houfe fhall be finifhed, all and
fingular the provisions mentioned in the act entitled, An act to eftablifh a market at the market-
houfe in Chefter-town, in Kent county, and for the regulation of the faid market, and the dif-
ferent fupplements paffed thereto, fhall be and the fame are hereby extended to the market-
houfe to be built and eftablifhed by virtue of this act, fo far as the fame fhall not be inconfiftent
with any of the provifions herein contained.

IV. AND BE IT ENACTED, That Tuefdays and Fridays in every week fhall be fet apart, ap-
pointed and held, as market-days for faid market, as foon as the fame fhall be completely
finifhed.
