C H A P.

Commiffion-

ers to be ap-
pointed, &c.

VI. And be it Enacted, That the prefident and directors be and they are here-
by authorifed to appoint three commiffioners, neither of whom fhall be directly
or indirectly interefted in any of the lands through which the faid roads may or
fhall pafs, and the faid commiffioners, or a majority of them, fhall lay oat and
make a public road from Rifter's-town towards Hanover-town to the line of
Baltimore county, on as ftreight a line as the nature of the country and public
convenience will admit; and the faid commiffioners, or a majority of them,
fhall, in like manner, lay out and mark a public road from Rifter's-town afore-
faid to the town of Weftminfter, from Weftminfter to Taney-town, from Taney-
town to Emmitfburgh, from Emmitfburgh to the Pennsylvania line; provided,
that the faid roads, or either of them, fhall not be carried through any buildings,
garden or yard, without the confent of the owner and poffeffor thereof; and pro-
vided alfo, that the faid commiffioners, or a majority of them, fhall locate the
road from the line of Baltimore county, through Weftminfter-town, Taney-
town, Emmitfburgh, to the Pennfylvania line, in the manner the fame has been
heretofore located, cleared and confirmed, by the juftices of Frederick county
court, unlefs they, or a majority of them, fhall in their judgment and opinion
think it neceffary to ftreighten and amend the fame; and the prefident and direc-
tors fhall pay and fatisfy, out of the monies of the faid company, all reafonable
cofts and charges incurred by the faid commiffioners in laying out and marking
the aforefaid roads.

Who fhall

VII. And be it enacted, That the faid commiffioners, before they proceed to
the execution of the powers vefted in them by this act, fhall take the following
oath, or affirmation: " I, A. B. appointed a commiffioner to lay cut and mark
" a public road from Rifter's-town, by virtue of an act, entitled, An act to in-
" corporate a company for making feveral turnpike roads through Baltimore and
" Frederick counties, until they interfect the divifional line between Maryland
" and Pennfylvania, do fwear, or affirm, that I will lay out and mark the fame
" according to the belt of my fkill and judgment, and according to the directions
" of the faid act; and I do further fwear, or affirm, that I am not interefted in
" any lands through which the faid roads are likely to pafs."

And return
the courfes,
&c.

VIII. And be it enacted, That the commiffioners aforefaid, after they fhall
have laid out and marked the faid roads, are hereby directed to return the courfes,
bounds and plots thereof, to the clerk of Baltimore county court, and a duplicate
thereof to the clerk of Frederick county court, to be by them recorded at the
expence of the faid body corporate; and that the faid roads, fo laid out and re-
turned as aforefaid, fhall be for ever thereafter taken, held and adjudged, public
roads and common highways.

IX. And be it enacted, That the faid prefident and directors, and their fuc-
ceffors, or a majority of them, affembled, fhall have full power and authority,
from time to time, to agree with and employ any perfon or perfons, on behalf of
the faid company, to grub, clear, ftone and make faid roads fixty-fix feet in
breadth, in the manner hereafter directed, and to do all other things for the com-
pletion of faid roads in the manner required by this act; and that the prefident
and directors may eftablifh rules and regulations for conducting the bufinefs of
the corporation, and appoint the various officers and labourers, and pay all ex-
pences, which they may find neceffary.

X. And be it enacted, That the fums fo fubfcribed before the faid directors
fhall be appointed as aforefaid, fhall be paid to the directors as follows, to wit :
One fourth thereof at the end of one month after the election of the directors,

one fourth at the end of "one year after the election of the directors, one fourth
at the end of the eighteen months after the election of the directors, and the refidue
at the end of two years after the election of the directors; and that all fubfcrip-
tions which fhall be fo made, after the election of fuch directors, fhall be paid
in fuch manner, and in fuch proportions, as the faid directors fhall from time to
time order and direct; provided neverthelefs, that the directors for the time
being may, in their difcretion, fufpend, or totally releafe, the payments of any
