and exercife all the rights and authorities refpecting fuch elections which were
vefted in the commiffioners of Baltimore-town, in virtue of the constitution and
form of government.

II. And be it enacted, That all fuch parts of the constitution and form of
government as make the commiffioners of Baltimore-town judges of the elections
for delegates, and for elector of the fenate, be and the fame are hereby repealed,

III. And be it enacted, That this act fhall commence and be in force, if it
fhall be publifhed at leaft three months before the next election of delegates,
and fhall be confirmed by the general affembly, in their firft feffion after fuch
new election.

C H A P. LVIII.
An ACT to incorporate the prefbyterian church in the city of
Baltimore.

|
WHEREAS application hath been made to this general affembly for an
act of incorporation, in behalf of the prefbyterian church in the city
of Baltimore, which may enable them to manage with convenience
their temporal concerns,
|
Preamble.
|
|
|
II. Be it enacted, by the General Affembly of Maryland, That the prefent
committee of the faid church, confiding of the following perfons, viz. Wil-
liam Smith, Robert Purviance, James Calhoun, David Stewart, Robert Gilmor,
Samuel Smith, William Patterfon, Chriftopher Johnfon, George Brown, John
Swann, William Robb and James A. Buchanan, and their fucceffors, to be
elected as herein after mentioned, with their minifter for the time being, fhall be,
and hereby are created and declared to be, a body politic and corporate, by the
name, ftyle and title, of The Committee of the Prefbyterian Church in the City
of Baltimore, and by the fame name fhall have perpetual fucceffion, and fhall be
able to fue and be fued, implead and be impleaded, in any court of law or equity
in this ftate, or elfewhere, and to make and have a. common feal, and the fame
to break, alter or renew, at their pleafure, and alfo to ordain and eftablifh fuch
by-laws and ordinances as fhall appear neceffary for regulating the temporal con-
cerns of the faid church, and for promoting literature within the fame, not be-
ing repugnant to this act or the laws of this ftate.

III. And be it enacted, That the fucceffors of the prefent committee of the
faid church fhall be elected in the manner following, viz. The members of the
faid church being twenty-one years of age, holding a pew or part of a pew
therein, and not being in arrears more than fix months for the fame, may and
fhall meet, at fuch place as may be appointed by the faid corporation, on the
firft Monday of May, in the year eighteen hundred and one, or on any other
Monday of the fame month, and they may and fhall continue to meet in like
manner on the firft Monday of May every third year, or on any other Monday
of the fame month, whereof due notice fhall be always given by the prefident of
the faid corporation for the time being in the forenoon of the Sunday preceding
the day of fuch meeting, at the place where public worfhip is ufually held, and
then and there they, or fo many as may attend, fhall elect, viva voce, twelve
members of the faid church.

IV. And be it enacted That in cafe of the death or refignation of any lay
member of the faid body corporate, the remaining members, or a majority of
them, fhall have full power and authority, at their next or any fubfequent meet-
ing, to elect another perfon in his place;

V. And be it enacted, That all the lands and tenements, with their apperte-
nances, now vefted in truftees for the ufe of the faid church, and all other pro-
perty of the faid church, fhall be and are hereby abfolutely and unconditionally
