XLV.

juftices of the faid court fhall levy upon the affeffable property of the faid county

Preamble.

C H A P. XLVI.

An ACT to authorife the iffuing of a patent to Jacob Haynes, of
Wafhington county.

WHEREAS it is reprefented to this general affembly, that Norman
Bruce, of Frederick county, heretofore furveyed a fmall tract of
land, lying and being in Wafhington county, called Smear's Neglect,
containing feven acres of land, and afterwards, on the thirtieth day of April, in
the year feventeen hundred and ninety-two, affigned the certificate thereof to a
certain Jacob Haynes, of Washington county, for a valuable consideration, but
by miftake the affignment was made and endorfed to one Frederick Smears, of
the fame county, in whofe name a patent on the faid certificate has been
erroneously obtained: And whereas it is alleged, that the faid Jacob Haynes is
the perfon to whom the faid patent ought to have been granted; therefore,

Regifter to if-
fue a patent,
&c.

II. Be it enacted, by the general Affembly of Maryland, That the regifter
of the land-office for the weftern fhore be and he is hereby empowered and re-
quired to iffue a patent upon the faid certificate to the faid Jacob Haynes, as the
affignee thereof, in the fame manner, and to the like intent and purpofe, as if
the faid Jacob Haynes were mentioned and endorfed as fuch affignee; and the
faid Jacob Haynes, his heirs and affigns, fhall thereupon and thereafter be deem-
ed and considered as the legal proprietors of the faid tract of land; provided
neverthelefs, that nothing herein contained fhall in any manner affect the right
or title of the faid Frederick Smears, or of any perfon or perfons whatfoever, if
any there be, acquired or derived by, from or under the patent heretofore granted
as aforefaid.

C H A P. XLVII.
An ACT to prevent hogs from going at large in the town of
Weftminfter, in Frederick county,
WHEREAS it is reprefented to this general affembly, that fundry per-
fons do raife and keep great numbers of hogs, and fuffer them to
remain at large, in faid town, to the great injury of the inhabitants
thereof; therefore,

No perfon to
raife hogs,
&c.

II. Be it enacted, by the General Affembly of Maryland, That from and after
the paffing of this act it fhall not be lawful for any perfon or perfons whatfoever
to raife or keep any hogs within faid town, or within one half mile from the
center thereof, except in enclofures, or to fuffer any hogs to go and remain at
large therein; and if any hogs fhall be found going and remaining at large within
faid town, it fhall and may be lawful for any perfon or perfons to kill or im-
pound the fame, and if impounded, fuch perfons fhall immediately give notice,
by advertifements fet up at the moft public places in faid town, defcribing the
hogs fo impounded, and if the owner or owners fhall not, within five days there-
after, prove his or her property therein, and make compenfation for the injury,
if any, which may have been fuftained by any inhabitant of the faid town, to
be afcertained by any two difinterefted perfons, inhabitants as aforefaid, and fhall
not pay for every fuch hog the fum of two fhillings and fix-pence for every day
it fhall have been fo impounded, it may be lawful for the perfon or perfons, fo
impounding as aforefaid, to fell or kill the fame for his or her benefit.

III. And be it enacted, That if any perfon or perfons fhall be fued and im-
pleaded for killing, deft raying and felling, any fuch hog as aforefaid, the de-
fendant or defendants may plead the general iffue, and give this act and the
fpecial matter in evidence.
