1797.

V. And be it enacted, That one moiety of the forfeitures accruing and be-
coming due for any offence under this act fhall be applied to the ufe of the coun-
ty wherein the offence fhall be committed, and the other moiety to the perfon or
perfons who fhall profecute and fue for the fame, and the inhabitants of faid

county fhall notwithftanding be admitted witneffes to teftify againft any perfon
who fhall be profecuted for an offence by virtue of this act.

VI. Provided neverthelefs, That nothing in this act fhall, in any manner,
affect any of the chartered rights or privileges of the cities of Annapolis and
Baltimore, or of George-town.

An ACT for the relief of Mary Sweeny and William King, of
Prince-George's county.

WHEREAS the names of Mary Sweeny and William King were omit-
ted to be inferted in the act, entitled, An act for the relief of fundry
insolvent debtors, paffed at the prefent feffion of affembly,

Preamble.

II. Be it enacted, by the General Affembly of Maryland, That the benefits
refulting from the faid act fhall be and are hereby extended to the faid Ma-
ry Sweeny and William, in as full and ample manner as if the faid Mary
Sweeny and William King had been feverally mentioned in the faid act; provided
that the faid Mary Sweeny and William King feverally comply with the pro-
vifions of the fame.

C H A P. CXII.
A Further additional fupplement to the act, entitled, An act re-
lating to public roads in this ftate, and to repeal the acts of af-
fembly therein mentioned.

Be it enacted, by the General Affembly of Maryland, That from and after
the paffage of this act, the juftices of the levy court of Anne-Arundel
court, or any five of them, be and they are hereby authorised and em-
powered to allow to each fupervifor of the public roads in the faid county any
fum not exceeding one dollar and fifty cents for each day they may be employed
as fuch, agreeably to the directions of the original act to which this act is a fur-
ther additional fupplement.

C H A P. CXIII.
An ACT relative to lands devifed where there are no known heirs,
or the heirs are aliens.

WHEREAS by the Britifh ftatute, entitled, An act for the relief of
creditors againft fraudulent devices, which hath been extended to and
practifed under in this ftate, it is provided, that in all actions brought
by certain creditors for the recovery of debts due by perfons dying feized of lands
and tenements, and deviling the fame by their wills and teftaments, the devifees
and heirs at law fhall be joined by virtue of the faid ftatute; and there being no
provifion therein for cafes where there are no heirs, or where the heirs at law,
or any of them, are aliens, or unknown, or nonrefidents of this ftate, doubts
are entertained whether in fuch cafes creditors can have remedy at law ;

every cafe where any perfon hath died, or fhall die, feized of lands, tenements
or hereditaments, and fhall have devifed, or fhall devife the fame in any lawful
manner whatfoever, not leaving any heir or heirs, or leaving any heir or heirs at
law not being citizens or refidents of this ftate, in all and every fuch cafe it fhall
and may be lawful for any creditor or creditors of every fuch devifor to have and
maintain his, her or their action and actions againft the devifee or devifees to
whom fuch lands, tenements or hereditaments, may be devifed, without joining
the heir or heirs at law in any fuch action or actions; and fuch creditor or cre-
