mental hygiene, and who shall be certified in psychiatry by the
American Board of Psychiatry and Neurology. Dr. Isadore Tuerk
shall become the Commissioner and shall serve in that capacity as
long as he performs his duties in a competent manner. The Com-
missioner of Mental Hygiene shall receive such salary as may be
provided in the budget, and he shall continue in office until removed
by the Governor for incompetency or misconduct, under the pro-
visions of Section 15 of Article II of the Constitution. The Com-
missioner of Mental Hygiene shall be responsible for discharging
the functions assigned by the Board of Health and Mental Hygiene
to the State Department of Mental Hygiene, and for the adminis-
tration of that Department.

The Commissioner of Mental Hygiene shall organize the Depart-
ment of Mental Hygiene as may be necessary to carry out the re-
sponsibilities and functions of the Department. The Commissioner
of Mental Hygiene shall have such assistants, employees and pro-
fessional consultants as may be provided in the budget.

The Commissioner of Mental Hygiene shall appoint, with the ap-
proval of the Board of Health and Mental Hygiene, a superintendent
of Spring Grove State Hospital, Springfield State Hospital, the
Eastern Shore State Hospital, Crownsville State Hospital, Rosewood
State [Training School] Hospital and the Clifton T. Perkins State
Hospital, as well as any additional hospitals which may come within
his administrative jurisdiction.

ARTICLE 59

19. Spring Grove State Hospital, Springfield State Hospital, the
Eastern Shore State Hospital, Crownsville State Hospital, and Rose-
wood State [Training School] Hospital shall hereafter exercise their
functions under the supervision, direction and control of the Depart-
ment of Mental Hygiene. The several boards of managers of said
institutions are hereby abolished and all property, real and personal,
of every kind, held by said boards of managers of said institutions,
as corporations, is hereby transferred to the State of Maryland. The
tenure of office of the superintendent of each of said institutions
shall expire on June 1, 1949, and on said date the Commissioner of
Mental Hygiene, upon recommendation of the advisory board, shall
appoint a superintendent for each of said institutions. Upon every
occurrence of a vacancy thereafter in the position of superintendent
of any of said institutions, the Commissioner, upon recommendation
of the advisory board, shall appoint the successor. Each superin-
tendent, except the superintendent at Rosewood, shall be a trained
psychiatrist and shall be familiar with the administration of insti-
tutions for the care and treatment of the insane. The superintendent
of the Rosewood State [Training School] Hospital shall be a physi-
cian, preferably qualified in psychiatry or pediatrics, and preferably
with experience in the field of mental retardation and familiar with
the administration of institutions for the care and treatment of the
mentally retarded. Their appointment shall not be subject to the pro-
visions of the merit system law, and they shall be subject to removal
by the Commissioner of Mental Hygiene for incompetency or mis-
conduct. Each of said superintendents shall receive such compensa-
tion as shall be provided in the budget, shall be responsible to the
