immediately after Section 37 thereof and to be under the new sub-
title "Liability for Damages", recodifying and changing the Code
reference for a section in Article 75C of the Code, which con-
cerns the liability of any person, firm, or corporation permitting
his premises to be used for sheltering persons during an attack
or raid, AND PROVIDING THAT NO ACTION SHALL BE
BROUGHT OR MAINTAINED UNDER CIRCUMSTANCES
FOR COMPENSATION FOR THE CUSTODY OR STOCKING
OF FOOD, WATER, MEDICAL SUPPLIES, EQUIPMENT AND
OTHER MATERIALS TO BE USED IN THE EVENT OF AN
ATTACK UPON THE UNITED STATES TO RECOVER CER-
TAIN DAMAGES FOR PERSONAL INJURY, PROPERTY
DAMAGE OR DEATH.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 7 of Article 75C of the Annotated Code of Maryland
(1957 Edition, as it may be amended), title "Prohibited Actions",
be and it is hereby REPEALED AND RE-ENACTED, WITH
AMENDMENTS, AND renumbered and recodified as Section 38 of
Article 16A of the Code, title "Civil Defense", this Article 16A
having been created by legislation enacted by the General Assembly
of 1962; said Section 38 to follow immediately after Section 37
thereof, and to be under the new sub-title "Liability aa4 FOR
Damages'%, AND TO READ AS FOLLOWS:

7.

(A) NO ACTION SHALL BE BROUGHT OR MAINTAINED
AGAINST ANY PERSON, FIRM, OR CORPORATION OWNING,
CONTROLLING OR OCCUPYING ANY REAL ESTATE OR
OTHER PREMISES WHO SHALL PERMIT SAID PREMISES TO
BE USED WITHOUT CHARGE OR COMPENSATION FOR
SHELTERING PERSONS DURING AN ATTACK OR RAID BY
AN ENEMY OR DURING A PRACTICE ATTACK OR RAID, TO
RECOVER DAMAGES FOR PERSONAL INJURIES TO OR THE
DEATH OF ANY PESON PERSON WHILE ON SAID PREMISES
DURING AN ACTUAL OR PRACTICE ATTACK OR RAID
OR FOR THE LOSS OR DESTRUCTION OF PERSONAL
PROPERTY TAKEN UPON SAID PREMISES BY ANY PERSON
SEEKING SHELTER THEREON DURING AN ACTUAL OR
PRACTICE ATTACK OR RAID.

(B) NO ACTION SHALL BE BROUGHT OR MAINTAINED
AGAINST ANY PERSON, FIRM, OR CORPORATION OWNING,
CONTROLLING OR OCCUPYING ANY REAL ESTATE OR
OTHER PREMISES WHO SHALL PERMIT SAID PREMISES
TO BE USED WITHOUT CHARGE OR COMPENSATION FOR
THE CUSTODY OR STOCKING OF FOOD, WATER, MEDICAL
SUPPLIES, EQUIPMENT, AND OTHER MATERIALS, OR ANY
OF THEM, TO BE USED IN THE EVENT OF AN ATTACK
UPON THE UNITED STATES, TO RECOVER DAMAGES FOR
PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH SUF-
FERED BY ANY PERSON ON OR ADJACENT TO THE PREM-
ISES, WHILE THE FOOD, WATER, MEDICAL SUPPLIES,
EQUIPMENT, AND OTHER MATERIALS, OR ANY OF THEM,
ARE BEING MOVED INTO, AROUND OR FROM THE PREM-
ISES, OR STORED THEREIN, OR DURING INSPECTIONS OR
VISITS CONNECTED THEREWITH.
