perfon charged, or leave at his place of abode, a proved account, ftating the

taxes and the amount of fees to the officers refpectively, together with all pay-
ments that may have been in any manner made by fuch perfon, and the balance
then due thereon, and if the perfon or perfons owing fuch taxes or officers fees
fhall neglect or refufe to pay the fame, it fhall and may be lawful for the laid So-
lomon Holland, or his deputies, to collect the lame by execution or diftrefs of
property of the perfon or perfons fo refuting or neglecting, and to fell and difpofe
of the fame at public auction, on giving five days notice, (excluding the day of
feizure and day of fale,) by advertifement let up at the moft public places in the
neighbourhood, and at the court-houfe door of the county, of the day and hour
of fuch fale.

XXXVIII.

III. Provided always, and be it enacted, That all the books of faid fheriff,

and his deputies, in which their accounts as fheriff and collector are ftated and
kept, fhall be depofited in the hands of fome perfon at the town wherein the court-
houfe of the faid county is fituated, to be infpected and examined by any perfon
or perfons who fhall apply for the fame, in order to afcertain any payments that
may have been made upon his or her account.

C H A P. XXXIX.

Proviso.

An ACT to empower Richard Johns to collect the balances due

him as fheriff and collector of Talbot county.
WHEREAS it is reprefented to this general affembly, by the petition of
Richard Johns, late fheriff and collector for Talbot county, that be
hath many balances due him as fheriff and collector aforefaid, and
that by reafon of ficknefs, and other unavoidable accidents, he was prevented
from finifhing his collection as fheriff and collector aforefaid within the time
limitted by law, and the laid Richard Johns hath prayed he may be empowered
to collect all fuch balances due him as aforefaid in the fame manner he might
have done during the time of his commiffion and appointment, in virtue of his
faid feveral offices of fheriff and collector; and this general affembly, for the
reafons dated in faid petition, are willing to grant him fome indulgence,

Preamble.

II. Be it enacted, by the General Affembly of Maryland, That the faid Richard
Johns be and he is hereby authorifed and empowered to take, demand, collect
and receive, all and every fum or fums of money, quantity or quantities of to-
bacco, due him as fheriff and collector for the year feventeen hundred and ninety-
four, of the public affeffment, county rates or officers fees, in the fame manner
as he might have done were his feveral offices unexpired; and the faid Richard
Johns fhall be allowed until the firft day of October next to complete the collec-
tion of the balances aforefaid for the year feventeen hundred and ninety-four,
and fhall be allowed the fame commiffion upon the faid collections that he would
have been entitled to had his feveral offices been unexpired.

R. Johns may
collect, &c.

III. Provided always, and be it enacted, That the faid Richard Johns, or
fome perfon or perfons authorifed by him, fhall, at leaft ten days before the exe-
cution or diftrefs of property for the balances aforefaid, deliver to the perfon
charged, or leave at his or her place of abode, a proved account, ftating the
taxes and the amount of fees, or fuch part thereof as may be claimed as due,
together with all payments that may have been in any manner made by fuch per-
fon, and fhall give at leaft five days notice, by advertifement at the moft public
places in the neighbourhood, of the time and place of fale, in cafe of fuch exe-
cution or diftrefs and provided alfo, that all the books of the faid Richard
Johns, and his deputies, in which his accounts as fheriff and collector are ftated
and kept, fhall be depofited in the hands of fome perfon in the town of Eafton,
to be infpected and examined by every perfon who fhall apply for the fame, in
order to afcertain any payments that may have been made upon his or their ac-
count.
