CHAP.
XVIII.

of this act, or fubject to the regulations of the market; and provided alfo, that
nothing in this act contained fhall extend or be conftrued to extend to prohibit
any ftore-keeper from retailing any of the articles aforefaid, which he may have
for fale, on the market-days and market-hours aforefaid.

Perfons not to
buy,

III. And be it enacted, That if any free perfon fhall buy, or caufe to be
bought, of any perfon bringing or having brought to the faid town any article of
provifion on market-days and during market-hours, at any other place than at
the market-houfe or ground aforefaid, fuch perfon fhall forfeit and pay the fum
of fifteen fhillings current money for each offence.

Or fell out of
market, &c.

IV. And be it enacted, That from and after the firft day of May next afore-
faid, if any perfon fhall fell or caufe to be fold any article of provifion upon
market-days and during market-hours, at any other place than in the market-
houfe or on the ground aforefaid, fuch perfon fhall forfeit and pay the fum of
fifteen fhillings current money for each and every offence.

How fines are
to be recover-
ed, &c.

V. And be it enacted, That all fines impofed by this act fhall be recovered
before a fingle magistrate, the one half to the informer, the other half fhall be
retained by the magiftrate, and be by him accounted for and paid to the juftices
of the levy court of faid county at their annual meeting.

And monies
applied.

VI. And be it enacted, That all monies that may be received by the juftices
of the levy court in virtue of this act, or fo much as they may think neceffary,
fhall be applied to making any neceffary repairs or improvements to the faid mar-
ket-houfe and ground,

Duration.

VII. And be it enacted, That this act fhall be in force for the term of two
years, and until the end of the next feffion of affembly that fhall happen thereafter.

C H A P. XIX.

Paffed De-
cember 24.

An ACT to furvey, continue and extend, certain ftreets in Tho-
mas Beall, of George's, addition to George-town, in Montgo-
mery county.

Preamble.

WHEREAS Thomas Sim Lee, Thomas Turner, George Magruder,
William H. Dorfey, Thomas Beall, of George, Stephen B. Balch,
Thomas Clarke, Andrew White, James Simpfon, Samuel Turner,
junior, Francis Lowndes and Uriah Forreft, inhabitants of George-town, and
the additions thereto, in Montgomery county, have, by their petition to this ge-
neral affembly, prayed for the continuation of Gay-ftreet, Dumbarton-ftreet,
Beall's-ftreet, Weft-ftreet and Back-ftreet, in Thomas Beall, of George's, addi-
tion to George-town, to interfect High-ftreet in Beatty and Hawkin's addition
to George-town, and to continue Congrefs-ftreet until it fhall interfect Eighth-
ftreet in Beatty and Hawkin's addition to George-town aforefaid, as a meafure
of great public utility and convenience; and it appearing to this general af-
fembly, that to extend and continue the faid ftreets will greatly contribute to
the convenience of the inhabitants and to the regularity of the town; there-
fore,

II. Be it enacted, by the General Affembly of Maryland, That John Temple-
man, Francis Lowndes and John Threlkeld, be and they are hereby appointed
commiffioners, and they, or a majority of them, are hereby authorifed and re-
quired, at fome time before the firft day of Auguft next, to caufe the aforefaid
Gay ftreet, Dumbarton-ftreet, Beall's-ftreet, Weft-ftreet and Back-ftreet, in
Thomas Beall, of George's, addition to George-town, to be furveyed, laid, off
and continued, of their prefent width, in ftreight lines, until they fhall feverally
interfect High-ftreet continued in Beatty and Hawkin's addition aforefaid, and
continue Congrefs-ftreet and Eighth-ftreet in Beatty and Hawkin's addition
to George-town aforefaid, until they fhall interfect each other.
