LAWS of M A R Y L A N D.

C H A P.

XIV.

erecting thereon a market-houfe, and have prayed that the fame, when erected,
be put under proper regulations ;

Truftees ap-
pointed, &c.

II. Be it enacted, by the General Affembly of Maryland, That Jacob Shell-
man, Samuel Norris, Henry Baer, Thomas Taylor and David Levy, junior, or
a majority of them, be and they are hereby appointed truftees, with full power
and authority in them vefted to purchafe, in fee-fimple, the aforefaid lot of
ground, and to erect, or caufe to be erected thereon, a market-houfe, for the
vending and felling provisions on the days herein after mentioned; which faid lot
of ground, when purchafed, and the building which may be thereon erected,
fhall be held by the aforefaid truftees, and their fucceffors, in truft, for the pur-
pofes contemplated by this act.

They fhall

appoint a
clerk.

III. And be it enacted, That the faid truftees fhall appoint a perfon of good
repute and fkill to be clerk of the aforefaid market, who may be removed from
office by the faid truftees, and the faid truftees fhall, from time to time, fupply any
vacancy in the office of clerk of the faid market; and the laid clerk, before he
acts as fuch, fhall take an oath, or affirmation, that he will diligently and faith-
fully perform the feveral duties of clerk of Bentz-town market, a certificate of
which qualification fhall be filed among the proceedings of the faid truftees.

Who fhall
have authori-
ty, &c.

IV. And be it enacted, That the clerk, fo appointed as aforefaid, fhall have
authority at all times to take care and charge of the market-houfe and ground
aforefaid, to difpofe of the ftalls and fhambles therein, to examine and infpect the
provifions or market-ftuff brought thereto for fale, and if any be found unwhole-
fome, to feize and deftroy the fame, to weigh and meafure, if neceffary, all pro-
vifions brought as aforefaid, and if any be found deficient in weight or meafure,
it fhall be the duty of the clerk to feize the fame, and difpofe thereof at public
fale at the faid market-houfe.

Market-days,
&c.

V. And be it enacted, That as foon as faid market-houfe fhall be erected and
completed, two days in every week, to wit, Tuefdays and Fridays, fhall be
deemed and confidered market-days, until ten o'clock in the morning of each
day, any laws or regulations to the contrary notwithstanding.

How vacan-
cies are to be
filled.

VI. And be it enacted, That on the death, removal from Frederick county,
or refignation, of any of the laid truftees, the major part of the remaining truf-
tees fhall appoint another to ferve inftead of fuch truftee fo dying, removing or
refigning.

Clerk to keep
a fair account.

VII. And be it enacted, That the clerk appointed as aforefaid fhall keep a
fair account of all monies by him received in virtue of this act, and fhall pay
over the fame to the truftees aforefaid; and the faid truftees fhall allow the clerk
a fum not exceeding ten pounds current money, and the refidue of the money to
be applied towards the repairs and improvement of the faid market-houfe.

No perfon to
flaughter in
the market-
houfe, &c.

VIII. And be it enacted, That no perfon fhall flaughter any cattle in or near
the faid market-houfe, nor put any horfe or other cattle in or under the fame,
under the penalty of ten fhillings current money for every offence.

An ACT to incorporate the Roman catholic congregation in Bal-
timore-town.

Preamble.

WHEREAS the right reverend John Carroll, Roman catholic bifhop of
Baltimore, the reverend Francis Beeften, Robert Walfh, James Bar-
ry, David Williamfon, Charles Ghequiere, Charles O'Brien, Luke
Tiernan and George Rofenfteel, have, by their petition to the legiflature, prayed
that certain perfons be appointed truftees of the Roman catholic congregation of
Baltimore-town, and to be incorporated as a body politic, with power to pur-
chafe, poffefs, hold and enjoy, to them and their fucceffors, any property, real,
