1794.

IX. And be it enacted, That the faid market-houfe, and appertenancies, fhall
be and the fame are hereby vefted in the faid commiffioners, and their fucceffors,
for the ufe of, and in truft for, the faid town; and the clerk of the faid market'
under the direction of the faid commiffioners, fhall have power to rent out the
flails and mambles of the faid market-houfe, and to collect the rents, and fhall
half-yearly give to the faid commiffioners a fair account of all monies received by
him, and pay all fuch fums as may be due by him to the commiffioners aforefaid.

X. And be it enacted, That if any perfon refiding in faid town fhall hereafter
fufe any goat, hog or goofe, to go at large in the faid town, he fhall forfeit and
pay the fum of ten fhillings current money for every fuch goat, hog or goofe,
fuffered fo to go at large.

XI. And be it enacted, That it fhall be the duty of the clerk of the market,
and of all conftables of Charles county, to give information to a juftice of Charles
county of any breach of this law that may come to their knowledge, and that
all fines impofed by this act, fhall be recovered before a fingle magiftrate, the one
half to the ufe of the informer, the other half to he paid to the faid commif-
fioners.

XII. And be it enacted, That all monies that may to received by the com-
millioners aforefaid in virtue of this law, fhall be applied to the following pur-
pofes, in the order following: Firft, to make a reafonable compenfation, not
exceeding ten pounds per year, to the clerk of the market, for his fervices; fe-
ccndly, to making any neceffary repairs or improvements to the market-houfe or
ground; thirdly, to reimburfe, in due proportion, fuch perfons who voluntarily
contribute to building the faid market-houfe; and the furplus, if any, fhall be
paid by the faid commiffioners to the order of the juftices who may lay the levy
for Charles county; and the faid commiffioners fhall annually lay their accounts
and proceedings before the county court of Charles county, and the fame fhall
be filed in the proceedings of the faid court.

CHAP. XLII.
An ACT for the benefit of the children of the late John Rogers
and Margaret Lee Rogers, deceafed.

WHEREAS William Kilty, who is adminiftrator de bonis non of John
Rogers deceafed, and adminiftrator of Margaret Lee Rogers, de-
ceafed, and who is alfo guardian to the children of the faid John
Rogers and Margaret Lee Rogers, by the choice of the two who are above the
age of fourteen years, to wit," John and William, and by the appointment of
the orphans court of prince-George's county, the three who are under that age,
to wit, Margaret, Thomas and Daniel, has fet forth by his petition to this ge-
neral affembly, that the intereft of the faid children might be promoted by a fale
of the perfonal property of the faid John Rogers and Margaret Lee Rogers, upon
credit, and by.other arrangements receding the faid eftates, under the authority
and direction of the legiflature, which the orphans court is not now empowered
to authorife; therefore, for the benefit and advantage of the faid children,

Preamble.

II. Be it enacted, by the General Affembly of Maryland, That it fhall and may
be lawful for the orphans court of Prince-George's county to authorife and era-
power the faid William Kilty, adminiflrator as aforefaid, to fell the perfonal
eftate of the faid John Rogers and Margaret Lee Rogers, upon a credit, not ex-
ceeding three years, firft giving four weeks notice in the Maryland Gazette, the
Columbia Chronicle, and feme one of the Baltimore papers, and by advertife-
ment at the court-houfc door, and other public places in Prince-George s county,
and taking bonds, each with not his than two good and fufficient fecurities for
die fame, which fecurities fhall alfo be approved of by the orphans court of the
faid county, and bearing intereft from the day of fale, the faid intereft to be paid
annually, and if not fo paid, the credit to be forfeited, and the bond liable to be
put in fuit.
