LAWS of MARYLAND.

CHAP.
XLL

Market-days
to be held,
&c.

III. And be it enacted, That within five weeks after the faid market-houfe
fhall be erected, the Wednefday and Saturday of every week fhall be held as
market-days, and the market-hours fhall be from any time in the morning until
noon of the faid days; the market-days and market-hours may neverthelefs be
changed by the faid commiffioners, after four weeks advertifement at the market-
houfe; and that all provifions and market-ftuff brought to the faid town, or
within two miles thereof, for fale, within the market-hours aforefaid, fhall be
brought to the faid market-houfe, or on the market-ground fixed on by the
county court aforefaid, and there fold or offered for fale; provided, that oyfters,
falted fifh, flefh, or butter by the cafk, butcher's meat on the hoof, or by the car-
cafe, grain, flour, meal and bread, fhall not be coniidered as provifions or market-
ftuff within the meaning of this act, or fubject to the regulations of the market.

Penalty for
buying out of
market, &c.

IV. And be it enacted, That if any free perfon fhall buy, or caufe to be
bought, of any perfon bringing, or having brought, to the faid town, or within
two miles thereof, any article of provifion or market-ftuff, on market-days, and
during market-hours, at any other place whatfoever than at the market-houfe,
or on the market-ground aforefaid, fuch perfon fhall forfeit and pay the fum. of
twenty fhillings current money for each offence.

For felling
out of mar-
ket, &c.

V. And be it enacted, That after the eftablifhment of the faid market, if any
free perfon fhall fell, or caufe to be fold, any article of provifion or market-ftuff
which fuch perfon may be fending or bringing, or having fent or brought, to the
faid town, or within two miles thereof, for fale, upon market-days and during
market-hours, at any other place than in the market-houfe, or on the market-
ground aforefaid, fuch perfon fhall forfeit and pay the fum of twenty fhillings
current money for each offence.

And for
flaughtering
in the mar-
ket-houfe,&c.

VI. And be it enacted, That no perfon fhall flaughter or butcher any cattle in
or near the faid market-houfe, nor put any horfe or other cattle in or under the
faid market-houfe, under the penalty of fifteen fhillings current money for each
offence.

A clerk to be
appointed,
&c.

VII. And be it enacted, That the commiffioners of the faid market fhall ap-
point a perfon of good repute and fkill to be clerk of the faid market, who may
be removed from office by the faid commiffioners, and the faid commiffioners
fhall, from time to time, fupply any vacancy in the office of clerk of the mar-
ket; and the clerk of the market, before he acts as fuch, fhall take an oath, or
affirmation, that he will diligently and faithfully perform the duties of clerk of
Charles-town market, a certificate of which qualification fhall filed among the
proceedings of the faid ccmmiffioners.

VIII. And be it enacted, That the clerk of the faid market fhall have autho-
rity at all times to take care and charge of the market-houfe and ground afore-
faid, and the market thereof, and to examine and infpect the provifions and mar-
ket-ftuff brought thereto for fale, and to try the weight or meafure of any pro-
vifions or market-ftuff made up in parcels, and if the fame fhall not be found of
the weight or meafare pretended by the perfon offering the fame for fale, to feize
the fame, and fell them at public auction at the market-houfe; and if any pro-
vifions or market-ftuff be found unfound or unwholefome, to feize and deftroy
the fame, and to try and adjuft the weights and meafures ufed at the faid market
by the ftandards of the county, and if any be found falfe or untrue, to feize the
fame, and if any can be altered, fo as to be made true, to fell the fame at public
auction at the market-houfe, or, with the confent and approbation of the faid
commiffioners, to deftroy them, if they be incapable of fuch alteration, one half
of the produce of all fuch fales to be retained by the clerk of the market for his
own ufe, the other half to be paid by him to the commiffioners of the market,
for the purpofes hereafter mentioned; and if any perfon fhall think him or her-
felf aggrieved by any feizure made by the faid clerk, he or fhe may, within five
days, appeal to the faid commiffioners, who fhall make fuch order therein as they
fhall think juft.
