LAWS of MARYLAND.

CHAP.

XXXIX.

brew-houfe, bake-houfe, ftill-houfe, cooper's or joiner's fhop, or other houfe or
fhop wherein any of the hazardous trades or bufineffes following are carried, on,
to wit: Apothecaries, chymifts, fhip-chandlers, tallow-chandlers, ftable-keepers,
innholders, malt-houfes, oil and colour men, or which are ufed as ftores for the
following hazardous goods, or any of them, to wit: Hemp, flax, tallow, pitch,
tar, turpentine, hay, ftraw and fodder of all kinds, and corn unthrefhed, fhall
be infured in this office, but on fuch terms only as fhall be concluded on by
fpecial agreement with the directors; and no policy fhall be extended, or
conftrued to extend, to the affurance of any fugar-houfe, brew-houfe, bake-
houfe, ftill-houfe, cooper's or joiner's fhop, or other houfe or fhop wherein
any of the hazardous trades or bufineffes above mentioned are carried on,
or where any large quantities of hazardous goods before enumerated are ftored
or lodged, unlefs the fame is exprefsly mentioned in the policy, and a pro-
portionable depofite paid, to be agreed on with the directors. ART. 9.
Every perfon infuring fhall depofite in the hands of the treafurer, as a pledge
for the performance of his covenant, a certain fum, to be agreed on with the
directors, for every one hundred pounds he fhall infure, according to the
greater or lefs hazard of the building on which the fame is infured, which depo-
fite money fhall be returned to the perfon or perfons fo depofiting the fame, his,
her or their executors, adminiftrators or affigns, at the expiration of his, her or
their refpective policies, together with a proportionable dividend of the profits
that have accrued, deducting loffes and incident charges only; provided, and it
is hereby agreed, that for the better and more certain adjufting the accounts of
this fociety, the faid depofite money fhall be demanded within one year next after
the expiration of each refpective policy, and in default of fuch demand, the fame
fhall become forfeit, and be funk to the depofiter for the benefit of the fociety.
ART. 10. Every perfon infuring in this fociety fhall pay for each policy, and
other the fervices incident thereto, the fum of one hundred and thirty-three cents,
and for the entry of every transfer the fum of forty cents. ART. 11. All per-
fons applying to the office of this fociety for infurance, fhall, before the furvey-
ing of his, her or their houfe or houfes, pay two dollars and fixty-feven cents
per policy earneft money, towards the charges of fuch infurance, which earneft
money fhall be taken in part of the charges of the infurance, in cafe the fame
fhall be made, and the policy or policies thereof be taken up within three months
then next after; and in cafe the faid policies fhall not, through default or neglect
of the perfon or perfons fo applying, be taken up within that time, then for
the better keeping and determining the accounts of the fociety, the faid poli-
cies fhall from time to time be cancelled by the directors, and the faid earneft
money fhall be funk to the payer for the benefit of the fociety; but in cafe
the directors for the time being fhall not agree to make the infurance fo ap-
plied fcr, then the earneft money paid fhall be returned; and when old po-
licies fhall be directed to be renewed, and the new policies fhall not be taken up
within three months next following fuch renewal, the new policies fhall alfo in
fuch cafe be in like manner cancelled, and the charge of the policy and furvey
fhall be deducted out of the depofite money of every fuch infurcr. ART. 12. All
and every perfon or perfons infuring in this fociety fhall receive one or more poli-
cy or policies for fuch infurance, under the hands and feals'of three at leaft of the
directors; all which affurances fhall be efteemed good and valid from the time
the charges of infurance and depofite money fhall be paid, and the perfon or per-
fons infured, having duly figned, fealed and delivered, this prefent deed of fettle-
ment; and all policies at their refpective expirations, and on return or accounting
for the depofite money and profits, fhall be delivered up to the fociety, and be
cancelled. ART. 13. And every perfon or perfons infuring in this fociety fhall
be bound and be obliged to pay his, her or their refpective proportions of all
loffes and charges happening and incurring in and to the fociety, and for that pur-
pofe fhall iign and execute thefe presents; provided neverthelefs, that he, fhe or
they, fhall not be obliged to pay a fum exceeding one half the amount of their
refpective depofites for each and every iingle fire, to make good the lofs thereby
fuftained, (a iingle fire being under-ftood to be a fire beginning in one houfe and
damaging or deftroying one or more houfes,) and fhould fuch fum be iniufficient
to make good fuch lofs, then the deficiency fhall be made up out of the intereft
arifing
