CHAP.
XII.

thereupon proceed to affefs and value the damages accordingly, of which the faid
petitioners, or fome one of them, fhall have at leaft five days previous notice,
and fuch inquifition fhall be final and conclusive between the parties.

V. And be it enacted, That the faid commiffioners fhall not lay out or open
the faid road through the buildings, gardens, orchards or meadows, of any per-
fon or perfons, without his, her or their confent.

Preamble.

CHAP. XIII.
An ACT to revive and aid the proceedings of the orphans court
of Calvert county.

WHEREAS it is reprefented to this general affembly, that the orphans
court of Calvert county flood adjourned until the fecond Tuefday in
February, feventeen hundred and ninety-four, and that no one of
the juftices of faid court attended to call the fame according to adjournment as
aforefaid, whereby all procefs and proceedings in the faid court were difcon-
tinued; for remedy whereof,

II. Be it enacted, by the General Affembly of Maryland, That all the rules,
judgments, entries, acts, procefs and proceedings, depending in the faid court on
the fecond Tuefday of February aforefaid, fhall be and are hereby revived, and
fhall be in the fame ftate and condition, to all intents and purpofes, as the fame
would have been in if the faid court had met on the faid fecond Tuefday of Fe-
bruary laft, and the faid rules, judgments, procefs and proceedings, had been
duly continued by regular and lawful adjournments from time to time.

III. And, whereas the juftices of faid court, notwithftanding the difcon-
tinuance aforefaid, have fince tranfacted the ordinary bufinefs of faid court;
therefore, Be it enacted, That all the rules, judgments, entries, acts, procefs
and proceedings, made and rendered by the juftices of faid court fince the faid
fecond Tuefday of February laft, either in cafes then depending or fince com-
menced, fhall be and are hereby made as valid and effectual as if the faid court
had met at the time to which the fame flood adjourned.

CHAP. XIV.
An ACT to alter the mode of collecting the county tax in Har-
ford county.

Be it enacted, by the General Affembly of Maryland, That Harford county
fhall and is hereby divided into four diftricts, in the manner following,
to wit: Deer Creek upper, Deer Creek middle, Deer Creek lower, and
Broad Creek hundreds, fhall form the firft diftrict; Harford upper, Harford
lower, Spefutiae lower, and Sufquehanna hundreds, fhall compofe the fecond dif-
trict; Spefutiae upper, Bufh River upper, and Bufh River lower hundreds, fhall
compofe the third diftrict; and Gunpowder upper, Gunpowder lower, and Eden
hundreds, fhall form a fourth diftrict.

Juftices to
meet, &c.

II. And be it enacted, That the juftices of the levy court in and for the faid
county fhall, on the firft Monday in May next, or within ten days thereafter,
and annually on the fame day, or within ten days thereafter, meet at the court-
houfe in faid county, and then and there appoint four fit and difcreet perfons as
and for collectors; that is to fay, one collector for each diftrict, who fhall be
refidents of faid county for one year next before their faid appointments, and
have a freehold therein.

III. And be it enacted, That each perfon who fhall be appointed collector as
aforefaid fhall have notice of his appointment as foon as conveniently may be by
the faid juftices of the peace, and fhall, within ten days thereafter, appear before
the juftices aforefaid on a day by the faid juftices to be appointed, and then enter
into bond before the faid juftices, with two fufficient fecurities, which faid prin-
cipal and fecurities fhall each be feized in fee of a clear real eftate to the full
value
