1793.

LAWS of MARYLAND.

C H A P.
LXXIII.

ten days after the faid fheriff's receipt thereof, under the penalty of five pounds
for each warrant not delivered by the clerk, and the like fum for each warrant
received and not delivered as aforefaid by the faid fheriff, to be recovered before a
fingle magiftrate, as in cafe of fmall debts out of court, and applied towards
clearing and amending the public roads, bridges and caufeways, aforefaid.

VII. And be it enacted, That if any of the faid fupervifors fhall not well and
fufficiently clear and amend the faid public roads within his diftrict, within a
reafonable time after the fame fhall be out of repair, or fhall not ftreighten the
faid public roads as marked and bounded by the commiffioners appointed and em-
powered, when directed by faid juftices, or fhall permit or fuffer any fallen trees,
or other obftruction, within his power, to remain, to lie in or acrofs any of the
faid public roads, whereby any waggon, cart or other carriage, may be obftructed
for the fpace of two days together, he having notice thereof, or fhall neglect to-
fall, or caufe to be fallen, all dead trees on each fide of the faid public roads,
whofe limbs hang over the faid road, and may by their falling injure travellers,
or fhall fuffer any of the bridges or caufeways in his faid diftrict to be out of re-
pair, or in any other manner fail in the performance of the duty of the fupervifor
of the public roads, after having accepted fuch office, he fhall forfeit and pay a
fum not exceeding five pounds current money for every offence, to be recovered
by indictment in the county court.

VIII. And be it enacted, That it fhall and may be lawful for the fupervifors
aforefaid, and any perfons to be employed by them, to take and carry away any
ftones, gravel, or earth of a firm quality, that may be found on any land adjoin-
ing the roads for which it may be wanted, without leave of the owner, or
making him any compenfation therefor; provided, that no ftone, quarried or col-
lected by the owner for his own ufe, or for fale, fhall be fo taken or applied, or
any enclofure laid open to obtain the fame, without the owner or owners leave
firft being obtained.

And give no-
tice, &c.

IX. And be it enacted, That the faid fupervifors fhall and they are hereby re-
quired, before they begin to ftreighten, amend or repair, any road within their
feveral and refpective diftricts, or to make or repair any bridge or caufeway, to
give notice, by advertifement fet up at the moft: convenient public and frequented
places in fuch diftrict, in order that the faid inhabitants may have an opportunity
of hiring labourers to the faid fupervifor, or labour themfelves in and upon the
faid roads, bridges or caufeways; and each fupervifor fhall be allowed a fum not
exceeding feven fhillings and fix-pence per day for every day he fhall attend.

Juftices to call
on the collec-
tor, &c.

X. And be it enacted, That the juftices aforefaid may and fhall, at their levy
court annually, call on the collector or collectors, and the feveral fupervifors, for
the fettlement of all monies levied and affeffed for the ufe of the roads as afore-
faid, and in cafe of neglect or refufal of the faid collectors or fupervifors to fettle
his accounts, and pay the balance or balances due from him or them, fhall im-
mediately commence fuit for the recovery thereof, in which no more than one
imparlance fhall be allowed.

XI. And be it enacted That if any perfon or perfons fhall prefume to alter or
change, or in any manner obftruct or encroach on, any of the faid roads, or on
any part or parts thereof, or to cut down or deftroy, deface or injure, any of the
bridges, caufeways, boundaries, marks or directions therein, fuch perfon or per-
fons, being thereof convicted in the county court, fhall be fined at the difcretion
of the court, in any fum not exceeding five pounds.

XII. This act to commence on the firft Monday of March next, and to conti-
nue in force till the firft Monday in March, feventeen hundred and ninety-five, and
from and after the aforefaid firft Monday of March next, the act, entitled, An
act for the marking of highways, and making the heads of rivers, creeks,
branches and fwamps, paffable for horfe and foot, paffed at September feffion,
feventeen hundred and four, and the feveral fupplements thereto, and an act to
