C H A P.
XXXVIII.
Commiffion-
ers to afcer-
tain damages,
&c.

VI. And be it enacted, That the faid commiffioners fhall afcertain and value
what damages may be fuftained by any perfon or perfons through whofe land the
faid road fhall pafs, and the fame, when fo affeffed, fhall be tranfmitted, levied
and paid, in the manner aforefaid: Provided always, that if any perfon or perfons,
through whofe land the faid road fhall pafs, or his, her or their guardian or
truftee, fhall conceive themfelves to be aggrieved by fuch valuation and affeffment
of damages by the faid commiffioners, it fhall and may be lawful for the faid
commiffioners, or any two of them, to iffue their warrant to any conftable of the
county, to fummon twelve freeholders of the county, not interefted in the pre-
mifes, and qualified to ferve as jurors in the county court, to appear on any day
by them to be appointed, on the premifes; and the faid commiffioners, or either
of them, are hereby authorifed to adminifter an oath to every perfon fo fummon-
ed, that he will, without favour, affection, prejudice or partiality, affefs the da--
mages fuftained by the perfons at whofe requeft fuch inquifition fhall be taken,
by reafon of opening the aforefaid road through his, her or their land; and the
perfons fo fummoned and fworn fhall thereupon proceed to affefs and value the
damages accordingly; and fuch inquifition fhall be final and conclufive between
the parties.

VII. And be it enacted, That all cofts and charges which may attend the lay-
ing out, opening and ftreightening, the aforefaid roads, fhall be at the expence of
the faid petitioners.

VIII. And be it enacted, That the faid commiffioners fhall not lay out or open
the faid roads through the buildings, gardens or orchards, of any perfon or per-
fons, without his, her or their confent.

IX. And be it enacted, That the faid roads, when opened as aforefaid, fhall
be kept in repair in the fame manner as all other public roads are in the faid
county.

Preamble.

C H A P. XXXIX.
An ACT for refurveying and laying out anew Salifbury-town, in

Somerfet county, and for other purpofes.
WHEREAS it is reprefented to this general affembly, that the plot of
the faid town, made by virtue of an act of affembly paffed for the
purpofe of locating the fame, cannot be found, and the boundaries
and limits of the ftreets, lanes and alleys, as well as many of the lots thereof,
are unknown, whereby the titles of the proprietors thereof are precarious and un-
certain, and it is prayed that the fame may be laid out anew, which appears to
this general affembly to be reafonable and proper ;

II. Be it enacted, by the General Affembly of Maryland, That Efme Bayly,
Francis H. Waters, James Polk, John Leathrbury, James Bennet, Gabriel
Slacomb and Benjamin Dennis, be and they are hereby appointed commiffioners,
who fhall, on or before the tenth day of May next, meet at Salifbury aforefaid,
and having fo met, the faid commiffioners, or any three of them, fhall have full
and ample power and authority to direct the furveyor of Somerfet county for the
time being, to furvey and make out an exact plot of the town, and fhall afcertain
and limit the extent of the lots, ftreets, lanes and alleys thereof, mo ft agreeably
to their original location according to the beft evidence that can be obtained.

III. And be it enacted, That the faid commiffioners, or any four of them, are
hereby authorifed and required, having firft given ten days notice of the time and
place of their meeting, to iffue fummons for fuch perfons as may be applied for
by any of the proprietors aforefaid, who are hereby required to attend, under the
penalty of twenty fhillings current money for every neglect or refufal, and to ex-
amine them upon oath, or affirmation, touching and concerning their knowledge
of the bounds, limits and extent, of any of the lots, ftreets, lanes and alleys, of
the faid town, and to eftablifh the fame accordingly.
