LAW S of MARYLAND.

C H A P.

LXXI.

fhall, for every fuch neglect, forfeit a fum not exceeding fifty pounds current
nioney; and if any perfon, appointed an afleflbr, fhall not appear at the time ap-
pointed, or fhall appear and refufe to ferve, the faid commiflioners, or a majori-
ty of them, fhall appoint, by warrant under their hands, fome other perfon,
qualified as aforefaid, as an afleflbr, in the room of the perfon fo making default
or refufing to ferve; and if fuch perfon fhall alfo make default, or refufe to act,
they may proceed to a new appointment, in like manner, and as often as neceffa-
ry, until the vacancy be fupplied; and if any affeffor fhall die, or be rendered
incapable to act, before he fhall have fully completed his valuation, the faid com-
miflioners fhall, by warrant under their hands, nominate fome perfon, qualified
as aforefaid, to be affeffor in the room of the afleflbr fb dying, or rendered inca-
pable to act, and the faid commiflioners, or a majority of them, fhall, immedi-
ately thereafter, fend fuch warrant to the perfon fo nominated affeffor.

XVIII. And be it enacted, That the commiflioners herein before named and
appointed for Baltimore-town, or the major part of them, fhall meet at fome
convenient place in the faid town, to be appointed by them, at the federal and
refpective times herein before mentioned and prefcribed for the meetings of the
commiflioners of the feveral counties; and the faid commiflioners for Baltimore-
town, or the major part of them, fhall then and there execute the feveral powers
and duties committed to and required of the commiflioners of the feveral counties
by this act, and fhall be liable to the fame penalties for omiffions or neglect of
duty as are impofed by this act on the commiffioners of the feveral counties.

And appoint
a clerk, &c.

XIX. And be it enacted, That the commiffioners of the tax for Baltimore--
town fhall meet at fome convenient place in the faid town at the time aforefaid,
or as foon thereafter as they may have notice of this act, and then and there ap-

point a clerk, and one or more fenfible and active perfons, inhabitants of the faid
town, and having property therein as aforefaid, to be afleffor or affeffors of the
real and perfonal property in the faid town; and the faid commiffioners fhall meet
on the firft day of May next, at fuch convenient place in the faid town as they
fhall appoint, for hearing and determining appeals, and fhall fit twenty days
thereafter (if neceffary) for the purpofe aforefaid, and fhall hear and determine
all fuch complaints as may be made to them by any perfon apprehending himfelf
aggrieved by the valuation to be made as aforefaid.

Oath of affef-
for, &c.

XX. And be it enacted, That every affeffor fhall, before he takes upon him-
felf the execution of his office, take the following oath, or affirmation, as the
cafe may be, to wit: " I, A. B. do fwear, that I will well and truly execute the
" duty of an afleflbr, and will faithfully, juftly and impartially, value all real
" and perfonal property which I fhall be appointed to value, agreeably to the
" directions of the act for the valuation of real and perfonal property within this
" ftate, according to the beft of my fkill and knowledge, and therein I will fpare
" no perfon for favour or affection, or any perfon grieve for hatred, malice or
" illwill. So help me God." Which oath, or affirmation, any of the commif-
fioners of the tax, or any juftice of the peace, may adminifter.

Perfons to de-
liver an ac-
count of
flaves, &c.

XXI. And, for the difcovery of all flaves and their ages, Be it enacted, That
every perfon owning any flave or flaves, or any perfon having the care and ma-
nagement of fuch flave or flaves, fhall deliver to the affeffor of the diftrict in
which fuch flaves live, when required by fuch afleflbr, an account of all flaves
owned by him, or under his care and management, with the name and age of
each, and fuch account fhall be dated and figned by the perfon making the fame;
and the afleflbr fhall view and examine each flave, and diligently inquire into his
age, and return the account of the owner or perfon having the management of
fuch flave, with his determination of the age, to the commiffioners of the tax ;
and if any owner, or perfon having the management of any flave, fhall omit to
give in any flave, or wilfully leffen or increafe his age, fuch owner or owners, or
perfon having the management of fuch flave, fhall pay double the tax on the real
value of fuch flave.
