C H A P.
LVII.

hundred and eighty-eight; and the faid truftees were further empowered and di-
reded by the faid ad, to recover from the new fubfcribers to the faid church the
monies due from them on their refpedive fubfcriptions: And whereas, by a fur-
ther fupplementary act, entitled, An act for building a new church in the city of
Annapolis, paffed November feffion, feventeen hundred and ninety, Charles
Wallace, James Brice and John Davidfon, Efquires, were empowered to open a
new fubfcription for the purpofe of finifhing the faid new church: And whereas
by a refolution of November feffion, feventeen hundred and ninety-one, the trea-
furer of the weftern fhore was direded to advance two hundred pounds for the
purpofe of building and finifhing a number of pews in the new church aforefaid :
And whereas it is the duty of the truftees appointed by the faid original act, and
by the further fupplementary act of November feffion, feventeen hundred and ;
ninety, to lay before the general affembly accurate ftatements of all monies by
them received and expended in building the faid church, and building and finifh-
ing the pews before mentioned ;

II. Be it enacted, by the General Affembly of Maryland, That the truftees
named in the before recited original ad, and in the further fupplementary act of
November feffion, feventeen hundred and ninety, be direded to lay before the
general aflembly, at the next November feffion, in ten days from the meeting
thereof, accurate accounts, ftating the feveral fums received by them, as well on
account of the public donations aforefaid as on account of the aforefaid quantity
of tobacco direded to be levied on St. Anne's parifh, and on private fubfcriptions,
and ftating in what manner the faid fums have been expended, and how much of
the fubfcriptions have been colleded by the faid truftees, and what proportion
thereof remains unpaid, and by which of the fubfcribers, and whether the whole
of the aforefaid quantity of tobacco has been colleded from the people, inhabi-
tants of St. Anne's parifh, and, if colleded, into whofe hands paid; and the
faid truftees are hereby further direded to inform the general aflembly, at the next
November feffion, within ten days after their meeting aforefaid, what fteps they
have taken, if any, to enforce payment of the fums of money due from perfons
who have made ufe of the materials colleded before the late war for building the
faid church, or from thofe into whofe hands monies or tobacco have been paid
by any fheriff, colleded from the inhabitants of St. Anne's parifh, and not by

them paid over to the faid truftees, or fome one of them.

C H A P. LVIII.

An ACT for the prevention of lotteries.

Lotteries pro-
hibited, &c.

Be it enacted, by the General Affembly of Maryland, That from and after
the commencement of this ad, it fhall not be lawful for any perfon or
perfons, bodies politic or corporate, within this ftate, without the per-
miffion of the legiflature thereof, to propofe to the public any fcheme of a lotte-
ry to be drawn within this ftate, or of a lottery for the difpofal of any kind of
property lying or being within this ftate, under the penalty of five hundred
pounds current money for every offence, to be recovered by bill of indictment,
either in the general court, or in the county court of the county where the offence
fhall be committed.

No perfon to

&c.

II. And be it enacted, That if any perfon or perfons fhall fell, or offer for fale,
within this ftate, any ticket or tickets in any lottery not authorifed by the legifla-
ture of this ftate, or by the congrefs of the United States, all and every fuch per-
fons and perfon fhall forfeit for every ticket fo fold, or offered for fale, the fum of
ten pounds current money, to be recovered in manner aforefaid.

Provifo.

III. Provided always, That nothing in this act fhall affect any perfon or per-
fons, bodies politic or corporate, for any thing or act to be done towards the
completion of any lottery which hath been or may be propofed and publifhed by
advertifement or otherwise, in any county of this ftate, before the commencement
of this act.
