At a SESSION of the GENERAL ASSEMBLY
of MARYLAND, begun and held at the City of
ANNAPOLIS on Monday the fifth of November,
and ended the twenty-third Day of December, in
the Year of our Lord one thoufand feven hundred
and ninety-two, the following LAWS were
enacted ;

C H A P. I.

An ACT to enable the court of appeals to continue certain caufes
depending in the laid court.

WHEREAS at June term laft paft, the faid court, from the ficknefs
and non-attendance of fome of the counfel concerned in caufes then
depending in the faid court, were induced to adjourn the fame until
Monday the fifth of this inftant, and the faid court is now fitting, and feveral
caufes before them cannot be heard and determined for want of time;

Preamble.

II. Be it enacted, by the General Affembly of Maryland, That the faid court
of appeals be and they are hereby authorifed to continue any caufe depending in
the faid court, until next June term, which they may think proper for a hearing
on the merits between the parties, and not for delay.

CHAP. II.

An ACT authorising certain commiffioners to iffue fummonfes
for witneffes in the cafe therein mentioned.

WHEREAS William Campbell and Robert Denny, Efquires, were ap-
pointed by the general affembly of Maryland; at November feffion,
one thoufand feven hundred and ninety-one, commiffioners to exa-
mine and fettle the claim of William Auguftine Washington againft the ftate of
Maryland, and it is now reprefented to this general aflembly by the faid William
Auguftine Washington, and the faid commiffioners, that the final adjuftment and
liquidation of the faid claim is greatly delayed by the want of power in the faid
commiffioners to compel the attendance of witneffes; therefore,

Preamble.

II. Be it enacted, by the General Affembly of Maryland, That the commiffioners
on the behalf of this ftate to fettle the faid claim, fhall have full power and au-
thority to iffue fummonfes to the fheriff of any county where witnefles, whofe
teftimony may be wanted in the examination of the faid claim, may refide, re-
turnable within thirty days from the date thereof, and the faid fheriff is hereby
authorifed and required to ferve the fame in like manner as if the faid fummonfes
had iffued from any court of record in this ftate, and fhall make due return
thereof to the faid commiffioners, according to the tenor of the faid fummonfes ;
and if any witnefs, fo fummoned, fhall refufe or neglect to appear before the faid
commiffioners on the day appointed for his attendance in the faid fummons, it
fhall and may be lawful for the faid commiffioners, in their difcretion, and
unlefs good caufe be fhewn to the contrary, to iflue an attachment of con-
tempt, returnable forthwith, againft any witnefs fo refufing or neglecting to ap-
pear, directed to the fheriff of the county where the witnefs fhall refide or may
be found, which faid fherifF is hereby authorifed and required to ferve the fame,
in like manner as attachments of contempt ifluing from any court of record in
the ftate, and upon fervice thereof to have the body of the faid witnefs forthwith
before the faid commiffioners, to teftify in the premifes, which faid witnefs, fo
