74-27 of the Montgomery County Code (1955 Edition), being Article
16 of the Code of Public Local Laws of Maryland, title "Montgomery
County", sub-title "Washington Suburban Sanitary District", as said
sections were repealed and re-enacted by Chapter 79 of the Acts of
the General Assembly of Maryland of 1955, be and they are hereby
repealed and re-enacted, with amendments, to read as follows:

1562 (74-27). For the purpose of carrying out the provisions of
this sub-title, said Sanitary District shall be under the jurisdiction
of a Commission of six members, [to be named by the Governor of
Maryland. The Governor shall appoint one from Prince George's
County and one from Montgomery County of his own selection; the
Governor shall appoint two members from nominations made by the
County Commissioners of Prince George's County; and the Governor
shall appoint two members from nominations made by the County
Council of Montgomery County] three of whom shall be residents of
Montgomery County and appointed by the Montgomery County Coun-

cil and three of whom shall be residents of Prince George's County

and appointed by the County Commissioners of Prince George's

County; the first appointments hereunder to be made on or before
June 1, [1955] 1959, upon which date the terms of office shall begin.
No person shall be appointed or continue in office as a member of
said Commission who holds any position of profit or trust under the
Constitution or laws of this State, or any political sub-division thereof.
All appointees shall be residents and taxpayers of said Sanitary Dis-
trict and shall serve for four years, or until their successors are
appointed and have qualified [.] , except that the terms of one
member appointed
NOMINATED by the County Commissioners
of Prince George's County and one member appointed
NOMI-
NATED by the County Council of Montgomery County, first
appointed under this Act, shall be for two years. Thereafter
the term of office of each of the members shall be for four years.

Not more than two members from each County shall be members of

the same political party. Any vacancy occurring at any time in the
[personnel] membership of the Commission shall be filled by the
Governor for the unexpired term, and the appointee named to fill
such vacancy shall be from the County for which such vacancy exists;
and if such vacancy exists for one of the appointments made from
nominations of either said County Commissioners or County Council
then the appointment to fill such vacancy shall be made by the Gov-
ernor from nominations of such Commission or Council. The annual
salary of the Chairman of said Commission shall be Forty-eight Hun-
dred Dollars ($4,800.00); of the Vice Chairman, [Forty-two Hundred
Dollars ($4,200.00)] Forty-five Hundred Dollars ($4,500.00); and
of the other members of said Commission, [Thirty-six Hundred Dol-
lars ($3,600.00)] Forty-two Hundred Dollars ($4,200.00), all pay-
able [monthly] bi-weekly. The Chairman and Vice-Chairman shall
perform such duties as the Commission shall from time to time
designate. The Commission shall, in June [1955] 1959 after the six
members have been appointed as herein provided, and in June every
[four] two years thereafter at its first meeting or as soon thereafter
as possible elect from among its members a Chairman and a Vice-
Chairman, one to be from Prince George's County and one to be
from Montgomery County, who shall serve for [the duration of their
terms of office] two years or until their successors are elected and
qualified.
