CHAPTER 606
(Senate Bill 471)

AN ACT to add new Section 276A to the Charter and Public Local
Laws of Baltimore City (1949 Edition, being Article 4 of the Code
of Public Local Laws of Maryland), title "Baltimore City", sub-title
"Probation and Suspension of Sentence", sub-heading "Probation
Department", to follow immediately after Section 276 thereof,
relating to disposition of unclaimed funds in the account of the
Probation Department of the Supreme Bench of Baltimore City,
and matters generally related thereto.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 276A be and the same is hereby added to the Char-
ter and Public Local Laws of Baltimore City (1949 Edition, being
Article 4 of the Code of Public Local Laws of Maryland), title "Bal-
timore City", sub-title "Probation and Suspension of Sentence", sub-
heading "Probation Department", to follow immediately after Section
276 thereof, and to read as follows:

276A. The Chief Judge of the Supreme Bench of Baltimore City
shall have power to require that any funds or bonds in the custody
of the Probation Department of the Supreme Bench received for
restitution or for the support of a wife, child or poor relative or for
collateral and which for a period of two years or more after the legal
expiration of the case shall have remained unclaimed or unidentified
or two years after the receipt of unidentifiable funds shall, after
diligent effort has been made to locate the person entitled to such
funds,
OR THE PERSON WHO PAID THE FUNDS INTO THE
CUSTODY OF THE PROBATION DEPARTMENT, be deposited
with the Treasurer of Baltimore City whose duty it shall be to
receive such funds and to hold them for a period of three years.
Should any
SUCH claimant within three years thereafter AFTER
SAID MONIES HAVE BEEN RECEIVED BY THE TREASURER
prove to the satisfaction of the Chief Judge of the Supreme Bench
his legal and just claim to any part of such funds, the Chief Judge
may by proper order require that repayment shall be made by the
Treasurer to such claimant as specified in such order. It shall be the
duty of the Clerk of the Supreme Bench to issue a certificate under
the official seal of the court embodying the terms and provisions of
such order and to transmit the same to the Treasurer, which certifi-
cate shall constitute the latter's authority for making such repay-
ment. After the lapse of such three year period all such funds re-
maining in the custody of the Treasurer shall be credited to the
general funds of the Mayor and City Council of Baltimore.

Sec. 2. And be it further enacted, That the intent of this Act is
to empower the Chief Judge of the Supreme Bench of Baltimore City
to order the disposition of unclaimed or unidentified funds and bonds
now in the hands of the Probation Department of the Supreme Bench
as well as in the future, in accordance with the provisions of Section
1 of this Act.
