88                                Laws of Maryland                        [Ch. 76

Whereas, Both these references are incorrect under State laws
recently enacted; and

Whereas, There is an incorrect word in one of these sections
which, also, should be corrected; now, therefore

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 91 and 92 of Article 23 of the Code of Public Local
Laws of Maryland (1930 Edition), title "Wicomico County", sub-
title "Foxes", be and they are hereby repealed and re-enacted, with
amendments, to read as follows:

91.    Any person who shall shoot a fox that is being pursued by a
dog or dogs in charge of a person or persons hunting the same for
sport in the limits of Wicomico County shall be guilty of a misde-
meanor, and on conviction thereof before a justice of the peace shall
be fined not more than ten dollars for each fox so killed, and stand
committed until the fine and costs are paid [, said fine to be paid over
to the Board of Education of said county for the use of the public
schools of said county]; provided, however, that this section shall
not apply to any landowner shooting a fox upon his own property.

92.    Any person who shall dig out, or in any manner take from
any den a female fox or her young whelps, or kill or in any manner
cause the death of such female fox or her young whelps during the
period of time in which she is [sucking] suckling them, shall be
guilty of a misdemeanor, and on conviction before a justice of the
peace, shall be fined not less than twenty-five dollars nor more than
fifty dollars for every female fox or whelp so dug or taken out of any
den or killed or caused to be killed, and shall stand committed until
such fine and costs are paid. [One-half of such fine to be paid to the
informer, the other half to be paid to the Board of County School
Commissioners of said county for the use of the public schools of
said county.]

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1959.

CHAPTER 76

(Senate Bill 44)

AN ACT to repeal Sections 97, 98, 99, 100 and 104 of Article 23 of
the Code of Public Local Laws of Maryland (1930 Edition), title
"Wicomico County", sub-title "Justices of the Peace and Con-
stables", said sections having been enacted by Chapter 11 of the
Acts of the Special Session of 1936, and Sections 98 and 100
thereof having been amended by Chapter 109 of the Acts of 1937,

Explanation: Italics indicate new matter added to existing law.

[Brackets] indicate matter stricken from existing law.
CAPITALS indicate amendments to bill.
Strike out indicates matter stricken out of bill.
