CHAPTER 583

(Senate Bill 87)

AN ACT to repeal and re-enact with amendments, Sections 97, 110
and 111 of Article 52 of the Annotated Code of Maryland (1957
Edition), title "Justices of the Peace", sub-title "Trial Magis-
trates System", fixing a maximum number of Committing Magis-
trates for Harford County, providing for their compensation, and
relating generally to trial magistrates in Harford County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 97, 110 and 111 of Article 52 of the Annotated Code
of Maryland (1957 Edition), title "Justices of the Peace", sub-
title "Trial Magistrates System", be and they are hereby repealed
and re-enacted, with amendments, to read as follows:

97. Appointment and Removal. The Governor, by and with the
advice and consent of the Senate, shall appoint for each County in
the State one or more justices of the peace to be known as "commit-
ting magistrates", and such number of justices of the peace at large
in the several counties, to be designated "trial magistrates", as is
hereinafter specified in Section 108; and in Prince George's County,
in addition to the aforegoing, seven justices of the peace, at large,
who shall be committing magistrates and shall have all the powers
and jurisdiction in the whole of said county, vested by law in justices
of the peace other than trial magistrates and substitute trial ma-
gistrates.

Any trial magistrate or substitute trial magistrate appointed pur-
suant to the provisions of this sub-title, may be removed as such
trial magistrates at any time by the Governor. Provided, however,
that in any such event, the trial magistrate who has received notice
of his removal shall be entitled to a hearing before the Governor
within fifteen (15) days after such notice if such trial magistrate
so requests in writing within five (5) days after such notice.

In Harford County the Governor shall appoint no more than fifteen
EIGHTEEN "Committing Magistrates" selected judiciously to serve
the entire county with a due regard for population and geography.

110.    Compensation of other Justices. Justices of the Peace other
than trial magistrates shall be paid by the County Commissioners,
as full compensation for their official acts and services in civil and
criminal cases, the sum of $20.00 annually, but in Kent, Talbot and
Queen Anne's Counties shall receive annually the sum of $50.00 and
in Washington County they shall receive the sum of $100.00 annually
and in Howard [County] and Harford Counties they shall receive
the sum of $200.00 annually; but they may retain all fees lawfully
charged by them for taking acknowledgments or affidavits unrelated
to their civil or criminal jurisdiction.

111.  Minimum Salaries Only. All salaries herein provided shall
be considered minimum salaries and may be increased at any time
by the county commissioners from county funds; and the county
