8 of Article 15A, may in any fiscal year, transfer from the Construc-
tion Fund described in this section, to the Motor Vehicle Revenue
Fund, a sum not to exceed [four million dollars ($4,000,000)] five
million dollars ($5,000,000), in such fiscal year, such funds, when so
transferred, to be used for the maintenance and operation of the
State highway system.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1959.

CHAPTER 258
(House Bill 397)
AN ACT to repeal and re-enact, with amendments, Section 75 of
Article 89B of the Annotated Code of Maryland (1957 Edition),
title "State Roads Commission", sub-title "Duties and Powers",
providing that the State Roads Commission shall apportion and
pay the real estate taxes on land acquired by it.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 75 of Article 89B of the Annotated Code of Maryland
(1957 Edition), title "State Roads Commission", sub-title "Duties
and Powers", be and the same is hereby repealed and re-enacted,
with amendments, to read as follows:
75. Payment of proportionate share of taxes on property acquired.
In all cases where the State Roads Commission acquires [buildings
used for residential, commercial or industrial purposes or acquires
all or substantially all of a parcel of unimproved] property, the real
estate taxes due thereon shall be apportioned as of the date the State
Roads Commission takes possession or has the right to take possession
or upon the actual transfer of title to the property to the State Roads
Commission, whichever occurs first, and the State Roads Commission
is authorized to pay its proportionate share of the said real estate
taxes due on said property.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1959.
