name of the State of Maryland, or by the State Board of Dental
Examiners in its own name, in any Circuit Court in any County or
in the Circuit Court of Baltimore City, as provided in sub-section
(b), to enjoin any person from the unauthorized practice of dentistry
under this sub-title. The pleadings, practice and procedure in such
action shall be in accordance with the law of
this State governing in-
junctions, provided, however, that such an injunction may be issued
without proof of actual damage sustained by any person or proof
that any persons will sustain damage if such injunction is not
granted.

(b)    Such action may be commenced in the county in which the
defendant resides, or in the county in which the defendant engages
in or attempts to engage in such unauthorized practice.

(c)    Such action shall be in addition to and not in lieu of criminal
prosecution of any person engaged in the unauthorized practice of
dentistry, and shall be in addition to and not in lieu of the authority
granted by law to the State Board of Dental Examiners to revoke
the license of any dentist. The granting and enforcing of an injunc-
tion against any person to prevent the unauthorized practice of
dentistry is a preventive measure and not a punitive measure, and
the fact that a person had been charged with or convicted of crimi-
nally having practiced dentistry or the fact that the license of such
person so to practice shall have been revoked, shall not prevent the
issuance of a writ of injunction to prevent the further practice of
dentistry by such person; and the fact that a writ of injunction has
been granted or issued to prevent or enjoin the further practice of
dentistry by any person shall not preclude the institution of criminal
proceedings against such a person or the punishment of such person
as the result of criminal proceedings.

(d)    For purposes of this section, "county" shall include Balti-
more City and "unauthorized practice of dentistry" shall include
violation of any of the prohibitory sections of this sub-title.

26.    Definitions.

(a) The practice of dental hygiene is defined for the purpose of this
subtitle as the removal of deposits, accretions and stains from the
[exposed surface] surfaces of the teeth and restorations and may in-
clude the polishing of the same and the charting of cavities during
such operations, the taking of dental X-rays and the application of
medicinal agents to the tooth for prophylactic purposes.

27.    Certificate to practice dental hygiene; fee.

Any person desiring to practice dental hygiene in this State [after
January 1, 1948,] shall procure from the State Board of Dental
Examiners of the State of Maryland, a certificate that such a per-
son is entitled to practice dental hygiene in the State of Maryland. In
order to procure such certificate, the applicant shall submit to the
Board his diploma from an institution for the education of dental
hygienists, which institution is approved by the Board, and such
other credentials as are hereinafter required, together with an ap-
plication on forms which shall be prescribed and furnished by the
Board. Each such applicant shall pay to the Board [ten dollars
($10.00)] fifteen dollars ($15.00) at the time of making such ap-
