for Kent County; provided that said appeal is taken within five days
thereafter, which appeal shall be heard de novo by said Court [at
its next regular term,] without the intervention of a jury, and if the
[said] Court, after hearing all the evidence, shall find that the
[said] County Road Engineer is incompetent or has been guilty of
neglect of duty, it shall pass an order removing [said] the engineer
from office, in which case the [said] Road Engineer shall not be
entitled to receive any salary from the date of the order of the
County Commissioners from which said appeal is taken.

300. The County Road Engineer shall reside in Kent County
during the term of his office and shall have [(entire)] entire charge,
control and supervision of the working, repairing, constructing and
reconstructing of the public roads and bridges in Kent County and
the purchase of the material thereof, all of which shall be subject to
the approval of the County Commissioners of Kent County [, and] .
He shall make all specifications for the building of new roads and
bridges, and shall see that no obstruction, hindrance or injury is or
shall be permitted upon any road or bridge under his supervision as
aforesaid. He shall employ such help, [teams] equipment and imple-
ments and contract for and purchase such material, subject to the
approval of the County Commissioners of Kent County, as he may
deem necessary for the working, repairing, constructing and recon-
structing said roads and bridges, to be paid by the said County Com-
missioners [; provided that he shall not employ any person or per-
sons to be paid a greater amount than one and one-half dollars per
day, without first obtaining the written consent of the County Com-
missioners for each person so employed]. He shall have charge and
control of all [teams, carts, wagons and other] equipment, machinery
and implements which may be purchased by the County Commis-
sioners for the use of [said] the roads. He shall not work out or
expend on the roads and bridges of said County a greater amount in
any one fiscal year than the amount levied by the County Commis-
sioners for the purpose, without obtaining the permission in writing
of said Commissioners. He shall appear before the Commissioners at
the first meeting in each and every month, and make a statement to
them of the work done, material furnished and money expended. He
shall examine and certify to the correctness of all bills and accounts
for any work done or materials furnished on any of the public roads
or bridges in Kent County before the same shall be paid by the
County Commissioners; and said County Commissioners shall make
no payments until such accounts have been certified by said Road
Engineer. He shall make out annually in writing a detailed report to
the Commissioners of all work done on the County roads and bridges
for the year, [together with the names of all persons working on said
roads and bridges, or furnishing material, and the amount to which
each person is entitled for such work and material and which he has
certified as correct,] which report shall be made on or before the
15th day of [June] January for the year ending on the thirty-first
day of the preceding [May] December, The said County Road Engi-
neer shall not be interested directly or indirectly in any firm or cor-
poration from which anything shall be purchased for the use of said
roads and bridges, nor receive any commissions on said purchase.

306. Whenever the County Road Engineer [shall find] finds it
necessary to open an outlet or watercourse through private property
in Kent County to secure proper drainage of any public road therein,
