sioners [Agricultural Agent,] after studying a financial report sub-
mitted to the County Commissioners by the operating auction after
the completion of each year of business. Any person, firm or corpo-
ration which did not conduct regular auctions during the previous
year shall furnish a bond in the amount of [$15,000,00] $2,000.00.
Provided, however, that any person, firm or corporation which desires
to conduct a livestock auction, and who did not conduct regular live-
stock auctions during the previous year shall furnish a bond in the
amount of $15,000.00. The bond shall be made payable to the County
Commissioners of Garrett County, conditioned upon saving harmless
any consignors from Garrett County, who shall send any such goods
for sale at the auction, from any failure or delay of more than three
days or if payment by check said check postmarked not later than
three days from the date of sale in making payment in full for any
goods sold at the auction. Nothing in this section shall be construed
to apply to or affect any private sale of any such goods. Any person,
firm or corporation violating the provisions of this section shall, upon
conviction thereof, be subject to a fine of not less than $500.00, or
shall be subject to imprisonment for not exceeding one year, or, in
the discretion of the court, to both such fine and imprisonment.
Sec. 2. And be it further enacted, That this Act is hereby de-
clared to be an emergency measure and necessary for the immediate
preservation of the public health and safety, and having been passed
by a yea and nay vote supported by three-fifths of the members
elected to each of the two houses of the General Assembly, the same
shall take effect from the date of its passage.

AN ACT to repeal and re-enact, with amendments, subsection (e)
of Section 18 of Article 64A of the Annotated Code of Maryland
(1957 Edition), title "Merit System", providing that unclassified
State employees may take promotional examinations for positions
in the classified service for which they are qualified, and to be
temporarily appointed to such classified positions.
Section 1. Be it enacted by the General Assembly of Maryland,
That subsection (e) of Section 18 of Article 64A of the Annotated
Code of Maryland, (1957 Edition), title "Merit System", be and it
is hereby repealed and re-enacted, with amendments, to read as
follows:
(e) Promotions.—Promotion is a change from one class to an-
other class with a higher maximum compensation, and vacancies
shall be filled by promotion as far as is consistent with the best in-
