(House Bill 871)
AN ACT to repeal and re-enact, with amendments, Sections 713 (e)
of Article 66C of the Annotated Code of Maryland (1957 Edition),
title "Natural Resources", sub-title "Oysters and Clams"; to add
new section 713 (y) to said Article to follow immediately after
Section 713(x) thereof; to repeal Section 714 of said Article and
to enact new Section 714 in lieu thereof, to stand in the place and
stead of the section so repealed relating to the methods for taking
soft shell clams in Queen Anne's County; to provide a minimum
size of such clams; to stipulate the times when and places where
said clams may be taken; to levy an inspection tax; and to provide
penalties for the violation of these provisions in said County; and
relating generally to soft shell clams in Queen Anne's County.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 713 (e) of Article 66C of the Annotated Code of Mary-
land (1957 Edition), title "Natural Resources", sub-title "Oysters
and Clams" be and the same is hereby repealed and re-enacted, with
amendments; that new section 713(y) be and the same is hereby
added to said Article to follow immediately after Section 713(x)
thereof; that Section 714 of said Article be and the same is hereby
repealed and new Section 714 enacted in lieu thereof, to stand in the
place and stead of the section so repealed; all to read as follows:
713.
(e) Measurements of rig; propeller guard and muffler in [Queen
Anne's and] Talbot [counties] County.—Each boat or rig shall have
but one conveyor or elevator for taking soft shell clams, not to exceed
nineteen (19) feet in length, measured from axle to axle. Each boat
or rig may be equipped with not more than one blade and one water
manifold each not exceeding thirty-six (36) inches in width.
All hydraulic or mechanical clam dredges and boats operating in
the waters of [Queen Anne's or] Talbot [counties] County licensed
and operating under the provisions of Section 715 shall have properly
installed a propeller guard and an adequate muffler on all motors
and engines used in the operation of said boat or hydraulic or
mechanical clam dredge. Any person violating any provision of this
subsection shall be deemed guilty of a misdemeanor and upon con-
viction thereof be fined not less than ten dollars ($10.00) nor more
than twenty-five ($25.00) dollars.
