County", sub-title "Fire Companies", to follow immediately after
Section 122 thereof, relating to a fire tax in the Third Election
District of Frederick County and providing for a referendum
thereon.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 122A be and it is hereby added to Article 11 of
the Code of Public Local Laws of Maryland (1930 Edition), title
"Frederick County", sub-title "Fire Companies", to follow immedi-
ately after Section 122 thereof, and to read as follows:
122A. In any year, when it is determined by Middletown Volun-
teer Fire Company that the sum to be paid by the County Commis-
sioners of Frederick County shall be insufficient to meet the needs
of said Company for that year or for the next ensuing year, said
Company shall submit to the County Commissioners a detailed ac-
counting of the needs of the Company for the year or years in ques-
tion. Thereupon, in preparing the County budget for the next ensu-
ing year, the County Commission COMMISSIONERS shall include
the amount of the deficit incurred in that year and/or the additional
amount needed by said Company for the next ensuing year, which
total sum shall be levied against the real and personal property
taxpayers of the Third Election District of Frederick County. In no
event shall this levy be greater than five cents per One Hundred
Dollars assessment on said property.
Sec. 2. And be it further enacted, That this Act shall not become
effective until it shall have been submitted to the qualified voters of
the Third Election District of Frederick County at the congressional
election to be held in Frederick County in November, 1960. There
shall be printed on the ballots to be used at said election, the title of
this Act and underneath said title on separate lines a square or box
or lever opposite the words "For Fire Tax", and a corresponding
square or box or lever to the right of and opposite the words "Against
Fire Tax", so that the voters EACH VOTER shall be able to desig-
nate his or her decision for or against said Fire Tax. If a majority
of the votes cast on said question shall be "For Fire Tax", then this
Act shall become immediately effective. If a majority of the votes cast
on said question shall be "Against Fire Tax", then this Act shall be
null and void and of no effect whatsoever.
Sec. 3. And be it further enacted, That this Act shall take effect
June 1, 1959.
