inclusion of customer-formula feeds and setting forth labeling and
other requirements appertaining thereto, and to correct typo-
graphical and punctuation errors occurring therein.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That sub-sections (b), (c) and (f) of Section 118 of Article 48 of
the Annotated Code of Maryland (1957 Edition), title "Inspections,
sub-title "Maryland Commercial Feed Law of 1958", be and they are
hereby repealed and re-enacted, with amendments; that^new sub-
sections (j) and (k) be and they are hereby added to said Section
118, to follow immediately after sub-section (i) thereof; that sub-
section (a) of Section 119 be and it is hereby repealed and re-enacted,
with amendments; that Section 120 of said Article and sub-title be and
it is hereby repealed and re-enacted, with amendments; that sub-
sections (a) and (c) of Section 121 be and they are hereby repealed
and re-enacted, with amendments; and that Sections 123, 124 (a),
124 (d) and 128 of said Article and sub-title be and they are hereby
repealed and re-enacted, with amendments, and all to read as follows:

118.

(b) Distribute; distributor. —The term "distribute" means to ex-
change, offer for sale, sell, or barter commercial feed, or customer-
formula feed,
or [otherwise] to supply, furnish or provide commercial
feeds or customer-formula feeds to a contract feeder, or otherwise
supply, furnish, or provide commercial feeds
as part of a commercial
enterprise. The term "distributor" means any person who distributes.
The term "distributee" means any person to whom commercial feed
or customer-formula feed is distributed.

(c) Commercial feed. —The term "commercial feed" means all
materials which are distributed for use as feed or for mixing in feed
for animals other than man except:

(1) Unmixed and unprocessed whole seeds and meals made di-
rectly from the entire seeds.

(2) Unground hay.

(3) Whole or ground straw, stover, silage, cobs, and hulls when
not mixed with other materials.

(f) Label. —The term "label" means a display of written, printed,
or graphic matter upon or affixed to the container in which a com-
mercial feed is distributed, or on the invoice or delivery slip with
which a commercial feed or customer-formula feed is distributed.

(j) The term "customer formula feed" means a mixture of com-
mercial feed" or materials, each batch of which mixture is mixed ac-
cording to the specific instructions of the final purchaser, contract
feeder, or other distributee.

(k) The term "contract feeder" means a person who, as an in-
dependent contractor, feeds commercial feed to animals pursuant to
a contract whereby such commercial feed is supplied, furnished or
otherwise provided to such a person and whereby such person's
remuneration is determined all or in part by feed consumption,
mortality, profits, or amount or quality of product.

(a) Commercial feed to be registered; application for registration;
