SEC. 3. And be it further enacted, That if any provision of this
Act or the application thereof to any person or circumstances is held
invalid, such invalidity shall not affect other provisions or applica-
tions of this Act which can be given effect without the invalid pro-
visions or application, and to this end the provisions of this Act
are declared to be severable.
SEC. 4. And be it further enacted, That this Act shall take effect
June 1, 1960.

CHAPTER 70
(House Bill 110)
AN ACT to repeal Sections 63, 64 and 65 of Article 97 of the Anno-
tated Code of Maryland (1957 Edition), title "Weights and Meas-
ures", sub-title "Solid Fuel", and to enact a new Section 63 in lieu
thereof, to stand in the place of the sections so repealed, to change
the manner of licensing and regulation of persons selling and
weighing solid fuel in the State.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sections 63, 64, and 65 of Article 97 of the Annotated Code of
Maryland (1957 Edition), title "Weights and Measures", sub-title
"Solid Fuel", be and they are hereby repealed; and that new Section
63 be and it is hereby enacted, to stand in place of the sections so
repealed, and to read as follows:
68.
General supervision of persons weighing solid fuel in connection
with the issuance of delivery tickets is hereby transferred from the
Department of Labor and Statistics to the Superintendent of Weights
and Measures. Whenever the words Department of Labor and In-
dustry, Chief Inspector of Licenses, or State License Bureau appear
in this sub-title, there shall be substituted therefor the words "Super-
intendent of Weights and Measures". All personnel, equipment and
records of the Department of Labor and Industry placed under its
supervision by Chapter 39 of the Acts of 1950 are hereby transferred
so as to be under the general supervision of the Superintendent of
Weights and Measures. The funds heretofore or hereafter provided
in the budget under the Department of Labor and Industry for the
purpose of paying salaries and expenses in connection with any duties
affected by this section are hereby transferred to the Maryland State
Board of Agriculture for the use of the Superintendent of Weights
and Measures.
