title "Natural Resources", sub-title "Fish and Fisheries", sub-
heading "Tidal Waters", said new sub-section to be known as Sub-
section (k) and to follow immediately after Sub-section (j) of
said section, restricting the use of haul seines in certain head
waters of the Chesapeake Bay7, AND RELATING GENERALLY
TO SUCH OFFENSE AND TO THE PENALTY THEREFOR.

Section 1. Be it enacted by the General Assembly of Maryland,
That a new sub-section be and it is hereby added to Section 261 of
Article 66C of the Annotated Code of Maryland (1951 Edition and
1956 Supplement), title "Natural Resources", sub-title "Fish and
Fisheries", sub-heading "Tidal Waters", said new sub-section to be
known as Sub-section (k) and to follow immediately after Sub-
section (j) of said section, and to read as follows:

261.

(k) It shall be unlawful for any person to use a haul seine in the

waters bounded by Locust Point on the southeast, and following the

shore line to the west end of the Spesutie Narrows Bridge on the

southwest, to point Concord on the northwest, to the Pumping Station
at Perry Point on the northeast, and to the eastern
point of the Fish-

ing Battery on the east and thence continuing on the southeast to
Locust Point.
WATER AREA WEST OF A LINE FROM LOCUST
POINT TO THE PUMPING STATION AT PERRY POINT. Noth-
ing in this sub-section shall be construed to prohibit the taking of
fish for conservation or scientific purposes under the supervision of
the Department of Tidewater Fisheries.
NOTHING IN THIS SUB-
SECTION SHALL BE CONSTRUED TO PROHIBIT THE TAKING
OF CARP, EXCEPT THAT IF TWENTY-FIVE OR MORE ROCK-
FISH ARE FOUND IN THE SEINE OR NET, THERE SHALL BE
A VIOLATION OF LAW AND THIS EXCEPTION SHALL NOT
APPLY. ANY PERSON FOUND GUILTY OF VIOLATING THE
PROVISIONS OF THIS SUB-SECTION SHALL BE DEEMED
GUILTY OF A MISDEMEANOR AND, UPON CONVICTION
THEREOF, SHALL BE SUBJECT TO A FINE OF NOT LESS
THAN ONE HUNDRED DOLLARS ($100.00) NOR MORE THAN
ONE THOUSAND DOLLARS ($1,000.00).

Sec 2. And be it further enacted, That this Act shall take effect
June 1, 1957.
