8 Laws of Maryland [Chs. 4, 5
CHAPTER 4
(Senate Bill 42)
AN ACT to repeal Section 43 of Article 10 of the Annotated Code of
Maryland (1951 Edition), title "Attorneys at Law and Attorneys
in Fact", sub-title "Attorneys in Fact", this section relating to a
power of attorney to execute a deed and being virtually a duplicate
of Section 31 of Article 21 of the Code.
Whereas, Section 43 of Article 10 in the 1951 State Code provides
that a power of attorney to execute a deed shall be exercised, ac-
knowledged and certified as required in Section 33 of Article 21 of
the Code; and
Whereas, It is clear from the text of said Section 33 of Article 21
that this cross reference is in error and that the cross reference
actually should be to what is now Section 31 of said Article 21; and
Whereas, rather than make a correction in a cross reference in
Section 43 of Article 10, it would seem that this section might simply
be repealed, since it is a virtual duplication of what is contained in
Section 31 of Article 21; now, therefore
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 43 of Article 10 of the Annotated Code of Maryland
(1951 Edition), title "Attorneys at Law and Attorneys in Fact",
sub-title "Attorneys in Fact", be and it is hereby repealed.
Sec. 2. And be it further enacted. That this Act shall take effect
June 1, 1957.
Approved January 28, 1957.
CHAPTER 5
(Senate Bill 44)
AN ACT to repeal and re-enact, with amendments, Section 202 of
Article 27 of the Annotated Code of Maryland (1951 Edition),
title "Crimes and Punishments", sub-title "Fraud—Drugs", clari-
fying the provisions of said section by removing duplicating lan-
guage therefrom.
WHEREAS, Chapter 121 of the Acts of 1902, which enacted what
is now Section 202 of Article 27 of the Code, contained a duplication
of language which makes this section difficult to construe; and
Whereas, It is desirable to remove the duplication without mak-
ing any substantive change in this section, in order to clarify its
reading and application; now, therefore
