THE AREA TO BE SERVED, AS CHEAPER RATES TO CON-
SUMERS WOULD RESULT; THEREFORE
Section 1. Be it enacted by the General Assembly of Maryland,
That a new section be and it is hereby added to Article 81 of the
Annotated Code of Maryland (1951 Edition and 1956 Supplement),
title "Revenue and Taxes", sub-title "What Shall be Taxed and
Where", said new section to be known as Section 8 (43), to follow
immediately after Section 8 (42) thereof, and to read as follows:
8. (43) Every artificial barrier, commonly called a dam, which
may be constructed across any navigable waterway THE POTOMAC
RIVER NEAR THE MOUTH OF THE MONOCACY RIVER IN.
MONTGOMERY COUNTY within the State by the Potomac Electric
Power Company. ANY ELECTRIC POWER COMPANY.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1957.

AN ACT to repeal and re-enact, with amendments, Section 76 of
Article 27 of the Annotated Code of Maryland (1956 Supplement),
title "Crimes and Punishments", sub-title "Cruelty to Animals",
defining the word "court" as used in said section to include
"magistrate", and providing that said magistrates shall have juris-
diction to hear violations therein. REMOVING FROM SAID SEC-
TION THE WORDS "IN THE DISCRETION OF THE COURT."
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 76 of Article 27 of the Annotated Code of Maryland
(1956 Supplement), title "Crimes and Punishments", sub-title
"Cruelty to Animals", be and it is hereby repealed and re-enacted,
with amendments, to read as follows:
76. Cruelty of any kind to animals a misdemeanor.
Any person who wilfully sets on foot, instigates, engages in, or in
any way furthers any act of cruelty to any animal, or any act tend-
ing to produce such cruelty, or by any act, conduct, neglect or omis-
sion wilfully causes, permits or suffers any animal to undergo any
species of torture or cruelty, shall be deemed guilty of a misdemeanor
and shall be punished by a fine not exceeding $100.00, or by
imprisonment not to exceed 30 days, or both. , in the discretion of the
court. The word "court" as used in this section shall include "magis-
trates" and said magistrates shall have jurisdiction to hear and act
upon any violations of this section.
