AN ACT to add six new sections to the Code of Public Local Laws
of Allegany County (1955 Edition), being Article 1 of the Code
of Public Local Laws of Maryland, title "Allegany County", said
new sections to be known as Sections 337-A to 337-F, to follow
immediately after Section 337 thereof, and to be under the new
sub-title "LaVale Zoning District", authorizing and empowering
the "LaVale Zoning Board" to adopt a comprehensive plan of
zoning rules, regulation's and restrictions affecting the erection,
extension and use of land and buildings in part of La Vale, Election
District No. 29 and relating generally thereto; and creating the
said Board and generally describing its membership, tenure,
powers, duties and responsibilities.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 337-A to 337-F, inclusive, be and the same hereby are
added to the Code of Public Local Laws of Allegany County (1955
Edition), being Article 1 of the Code of Public Laws of Maryland,
title "Allegany County", to follow immediately after Section 337
thereof, to be under the new sub-title "LaVale Zoning District", and
to read as follows:
337-A. The provisions of this sub-title shall apply and be effec-
tive in the boundaries of LaVale Election District No. 29 as set forth
in Section SOS of the Code of Public Local Laws of Allegany County
(1955 Edition), said boundaries being the same as the (present physi-
cal boundaries of Election District No. 29, Allegany County; except-
ing, however, that portion of said boundaries, and of said Election
District No. 29 as are set forth in Section 113 of the aforesaid Code
of Public Local Laws of Allegany County (1955 Edition), in that
Section 113 defines the limits of the Cresaptown Special Taxing
Area or District, and this sub-title does not intend to and does not
include in its provisions any application to any part of the Cresap-
town Special Taxing Area or District.
337-B. For the purpose of promoting health, safety, morals and
general welfare, of enhancing safety from fire, panic and other dan-
gers; of reducing traffic congestion; of providing adequate light and
air; of preventing the overcrowding of land and undue concentration
of population; of abetting provision of schools, parks and public
facilities; and to (promote the orderly growth of said LaVale Zoning
District in the interest of all its inhabitants, the LaVale Zoning
Board is hereby empowered within said District to regulate the use,
height, area and type of construction of buildings and the use of
land. The LaVale Zoning Board may, by appropriate regulations,
restrict, control, limit or regulate the erection, alteration, repair and
use of buildings and the use of land and regulate the number of
families which may be housed per acre of land.
