of space used by the Board in any building erected by the State of
Maryland or any of its agencies until such time as the Board's pro-
portionate amount of the purchase price of such building and the
Board's proportionate amount of such costs of repair and main-
tenance thereof as was expended from the Special Administrative
Expense Fund has been returned to such fund.

The moneys in this fund shall be continuously available to the
Board for expenditure in accordance with the provisions of this
Section and shall not lapse at any time or be transferred to any other
fund except as herein provided.

Sec. 2. And be it further enacted, That this Act is hereby de-
clared to be an emergency measure and necessary for the immediate
preservation of the public health and safety and having been passed
by a yea and nay vote, supported by three-fifths of all the Members
elected to each of the two Houses of the General Assembly of Mary-
land, the same shall take effect from the date of its passage.

CHAPTER 208
(Senate Bill 292)

AN ACT to repeal and re-enact, with amendments, Section 96 (c)
of Article 27 of the Annotated Code of Maryland (1956 Supple-
ment), title "Crimes and Punishments", sub-title "Desertion of
Wife or Child", including Kent County in provision for concur-
rent jurisdiction of Magistrates and Circuit Court in desertion
cases.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 96 (c) of Article 27 of the Annotated Code of Mary-
land (1956 Supplement), title "Crimes and Punishments", sub-title
"Desertion of Wife or Child", be and it is hereby repealed and re-
enacted, with amendments, to read as follows:

96. Punishment for desertion; procedure; payment of fine to wife;
recognizance; exceptions in certain counties, etc.

(c) In certain counties trial magistrates have concurrent juris-
diction with circuit court.—Provided that in Anne Arundel, Caro-
line, Carroll, Cecil, Charles, Dorchester, Frederick, Garrett, Harford,
Montgomery, Prince George's, Queen Anne's, St. Mary's, Somerset,
Talbot, Wicomico, Kent and Worcester counties, the trial magis-
trates shall have concurrent jurisdiction with the circuit court of
each of the respective counties to try persons violating the provi-
sions of this sub-title. And further provided, that in Allegany Coun-
ty the justice of the peace, known as the magistrate for juvenile
cases, shall have concurrent jurisdiction with the circuit court for
