AND DEVELOPMENT OF THE CLAM INDUSTRY IN ANNE
ARUNDEL COUNTY.

(D) IN ANNE ARUNDEL COUNTY IT SHALL BE UNLAW-
FUL TO TAKE OR CATCH SOFT SHELL CLAMS BY USE OF
HYDRAULIC, MECHANICAL OR OTHER DREDGE:

1.    ON SUNDAY, OR BETWEEN SUNSET AND ONE-HALF
HOUR AFTER SUNRISE ON ANY OTHER DAY, OR TO LAND
SOFT SHELL CLAMS BEFORE SUNRISE OR LATER THAN
ONE (1) HOUR AFTER SUNSET;

2.   WITHIIN 300 FEET OF ANY COMMERCIALLY PRODUC-
TIVE OYSTER TONGING AREA DEFINED ON THE CHARTS
OF THE COMMISSION OF TIDEWATER FISHERIES, OR AS
DEFINED UNDER SECTION 649 (I) OF THIS ARTICLE, OR
AS MARKED WITH STAKES AS MAY BE REQUIRED BY THE
COMMISSION OF TIDEWATER FISHERIES;

3.    WITHIN 500 YARDS OF ANY DULY LICENSED BLIND
DURING THE OPEN SEASON FOR DUCK OR GOOSE HUNT-
ING IN MARYLAND;

4.    DURING THE PERIOD FROM APRIL 15TH THROUGH
SEPTEMBER 15TH OF EACH YEAR WITHIN 500 FEET IN
FRONT OF ANY SEA NETTLE NET AND/OR ANY PUBLIC
BATHING BEACH AT ANY TIME; PROVIDED THAT THE
BEACH IS IN FACT RESORTED TO BY THE PUBLIC FOR
BATHING; AND PROVIDED THAT THE EXTENT OF THE
BEACH ALONG THE SHORE LINE IS MARKED AS MAY BE
REQUIRED BY ANY RULE OR REGULATION OF THE COM-
MISSION OF TIDEWATER FISHERIES;

5.   IN ALL THE TRIBUTARY WATERS OF ANNE ARUNDEL
COUNTY INCLUDING MARLEY CREEK, STONEY CREEK,
BODKIN CREEK, MAGOTHY RIVER INSIDE OF A LINE
DRAWN FROM MOUNTAIN POINT TO PERSIMMON POINT,
WHITEHALL BAY BETWEEN THE SHORE AND A LINE
DRAWN FROM HACKETTS POINT TO AND INCLUDING MILL
CREEK; SEVERN RIVER BETWEEN THE SHORE AND A
LINE DRAWN FROM GREENBURY POINT TO TOLLY POINT;
SOUTH RHODE AND WEST RIVERS BETWEEN THE SHORE
AND A LINE DRAWN FROM THOMAS POINT TO CURTIS
POINT, AND EXTENDING FIFTEEN HUNDRED (1,500) FEET
IN FRONT OF THE SANDY POINT STATE PARK AND THE
FORT SMALLWOOD PARK;

6.     ANYWHERE IN ANNE ARUNDEL COUNTY WITHIN
FIFTEEN HUNDRED (1,500) FEET OF THE SHORELINE
MEASURED FROM MEAN TIDE.

ANY PERSON VIOLATING ANY PROVISIONS OF THIS
SUB-SECTION SHALL BE DEEMED GUILTY OF A MISDE-
MEANOR AND UPON CONVICTION THEREOF BE FINED NOT
LESS THAN TWO HUNDRED DOLLARS ($200.00) NOR MORE
THAN ONE THOUSAND DOLLARS ($1,000.00), NOR MORE
THAN SIX MONTHS IN JAIL AND CONFISCATION OF BOTH
RIG AND BOAT. ALL VIOLATIONS OF THIS SUB-SECTION
SHALL BE TRIED IN THE CIRCUIT COURT OF ANNE ARUN-
DEL COUNTY.
